Biography

Vasanti Selvaratnam QC practises in international commercial arbitration and commercial court litigation, regularly handling multimillion-dollar disputes across a wide range of industry sectors, including shipping, trade and commodity disputes, banking and finance, insurance, jurisdiction disputes, conflict of law issues and civil fraud. She also specialises in all forms of interim relief, including freezing orders and anti-suit injunctions She is particularly noted for her user-friendly “hands-on” approach to cases, and her ability quickly to get to grips with disputes raising complex factual and technical issues that require a sound grasp of expert evidence and mastery of detail.

Reported cases include the House of Lords decision in The Starsin [2004] 1 AC 715; the Court of Appeal decision in The Wadi Sudr [2010] 1 Lloyd’s Rep 193 (leading case on the arbitration exception, the Judgments Regulation and issue estoppel); Joint Stock Asset Management Co Ingosstrakh-Investments v BNP Paribas [2012] 1 Lloyd’s Rep 649 (leading case on non-contractual anti-suit injunctions); Deutsche Bank v CIMB Bank Berhad [2017] EWHC 3380 (Comm) (raising issues under UCP 600 Arts 3, 6(e) and 14(c) and international banking practice in the context of chops and the 21 day rule);  and Rubicon Vantage Int Pte v Krisenergy Ltd [2019] EWHC 2012 (Comm) (first reported case to consider the construction of a parent company guarantee which is part “on demand” and part “see to it”).

Her professional memberships include Commercial Bar Association, the Chancery Bar Association, the London Common Law and Commercial Bar Association, the British Maritime Law Association, the ICC, the London Maritime Arbitrators Association, ICCA, the London Shipping Law Centre (head of education sub-committee) and the Bar European Group.

Vasanti was called to the Bar in 1983, and received her LLM in 1984. She has been a practising barrister at the Commercial Bar since 1985; a recorder since 2000; Queen's Counsel since 2001; a bencher of Middle Temple since 2011; and a member of the LOF panel of arbitrators since 2013. Vasanti accepts appointments as an arbitrator in a wide range of commercial disputes under all institutional rules as well as ad hoc.

Vasanti has considerable experience of shipbuilding arbitrations (being instructed on behalf of buyers in one of the first arbitrations to establish the existence of a serious design defect in a series of new build bulk carriers). She is currently instructed in a number of London Maritime Arbitrators Association (LMAA) arbitrations, many of which raise issues of general industry concern and topicality. These include a casualty involving a large container ship and loss of containers due to parametric rolling and confiscation of a vessel and its cargo by Saudi authorities, and the limits of the restraint of princes defence.

Vasanti also specialises in international trade finance and has a number of reported cases in this area.

Vasanti delivered the 37th Annual Donald O'May shipping industry lecture in 2019, on the subject of “Good Faith in English Law”.
