Tomas Vail founded Vail Dispute Resolution (VDR) in 2019. An innovative disputes practice based in London, VDR offers a unique blend of arbitration expertise and top-quality practical experience alongside the significant efficiencies that arise from an independent practice. VDR provides high-quality disputes advice without unnecessary costs and overheads, allowing for greater flexibility and bespoke solutions for each matter – including fixed fees and alternative funding solutions where appropriate.
Prior to VDR, Tomas spent the last decade working in the international arbitration groups at both Freshfields Bruckhaus Deringer and White & Case. He is recognised as a leading arbitration practitioner (Who’s Who Legal) and a leading practitioner of investor-state arbitration (Legal 500 UK).
Tomas regularly represents both states and investors in investment treaty arbitration proceedings under the ICSID and UNCITRAL rules. He also represents clients in commercial arbitration proceedings in the UK and abroad, including under the LCIA, ICC, SCC and UNCITRAL rules. His experience includes advising on complex energy and infrastructure disputes between investors and states/state-owned entities, particularly involving Russia, Ukraine and Kazakhstan.
Tomas recently wrote a book chapter on tribunal-appointed experts, in a commentary on the UNCITRAL Model Law (Cambridge University Press). He has also served as part of the leadership of several prominent arbitration organisations and initiatives, including as an Advisory Board member of the Institute for Transnational Arbitration. He also serves as a legal specialist to the American Bar Association's Rule of Law Initiative.
Tomas is a member of the bar in New York and a Solicitor of England and Wales. A native Russian and English speaker, Tomas is also fluent in French.
