Sean Gammons is a managing director in NERA’s energy, environment, communications and infrastructure practice and focuses on energy and commodity markets. He has over 20 years of advisory experience working for corporations, investors and governments on economic issues in these markets. His advisory work has covered market rules, tariff design and antitrust enforcement (eg, merger approval and state aid), as well as commercial work on contract design, pricing, investment appraisal and risk management. Mr Gammons has led numerous due diligence and valuation exercises in support of M&A transactions, greenfield investment and financings in the UK, Europe, the Middle East, Africa and Asia, covering regulated and deregulated assets.
Mr Gammons is an experienced expert witness and has provided expert testimony in commercial disputes (eg, construction, sale and purchase, post-M&A and broker disputes), investor-state disputes, antitrust matters and energy industry regulatory proceedings in a wide range of jurisdictions around the world, including the International Centre for Settlement of Investment Disputes (ICSID), the International Chamber of Commerce (ICC) and the English High Court. Examples of Mr Gammons’s expert work include damages estimation for non-delivery of gas and electricity and related expropriation claims; licensing disputes involving oil and gas resources; damages estimation related to changes in renewables tariffs; economic analysis in relation to price re-opener and loyalty clauses in long-term contracts for gas, gas storage and gas transport; liquefied natural gas (LNG) terminal and gas field construction disputes; and representations and warranties disputes in M&A deals for energy assets.
