Brent Olthuis is experienced trial and appellate counsel, having appeared before all levels of court in British Columbia and Ontario, and having acted in over 35 appeals before the BC Court of Appeal and in 10 before the Supreme Court of Canada. He also frequently represents parties in the commercial arbitration setting.

His practice encompasses a broad range of subject areas, from commercial and civil law to administrative/regulatory and constitutional law. He represents individual and corporate clients in both conventional and class actions, prosecuting or defending allegations such as breach of contract, breach of trust and fiduciary duty, breach of privacy, price fixing, product liability, negligence and professional misconduct.

His briefs of note include representing Imperial Tobacco Canada Limited in defence of a consumer protection class action, the attorney general of British Columbia in constitutional challenge to civil forfeiture legislation, and the City of Richmond in defence of a claim that certain of its lands are burdened by Aboriginal title. He was also external counsel to the auditor general of Canada in respect of the 2015 audit of the Senate.

He has been recognised as a leading litigation talent by numerous third-party publications, including Chambers and Partners, Benchmark Litigation and Martindale-Hubbell. The latter granted him an AV/Pre-eminent rating (the highest available), signifying that many of his peers rank him at the height of professional and ethical excellence. He presently serves as director of the BC Law Institute and was formerly a provincial council representative (Vancouver County) for the Canadian Bar Association BC branch.

WWL says: Brent Olthuis is well known among peers who commend his superb work handling complex commercial disputes before state and federal courts in Canada.
