Who's Who Legal Competition: Lawyers

Patrick Gay is a partner with the Herbert Smith Freehills’ competition, regulation and trade team based in Sydney. Patrick advises on all aspects of Australian competition law including merger control, cartels, market investigations and the structuring of distribution agreements and joint ventures. He also advises on consumer protection issues in the context of the Australian Consumer Law.

Patrick has acted in a number of significant competition law matters including acting for Tabcorp in its successful acquisition of Tatts following authorisation by the Australian Competition Tribunal in the wagering industry, advising Metcash in its successful acquisition of Home Timber & Hardware which included the negotiation of a behavioural undertaking with the Australian Competition & Consumer Commission (ACCC), and acting for Visa in respect of misuse of market power proceedings commenced by the ACCC.

Patrick is the co-author of the chapter on competition law and joint ventures in Before You Tie The Knot: Contemporary issues in Joint Venture Law and a chapter on merger clearance law in Australia in Towns Under Siege: Developments in Australian takeovers and schemes.

Patrick has a master’s degree in public administration and a Bachelor of Laws degree from Dalhousie University Canada. He is a member of the Law Council of Australia’s competition and consumer committee and the American Bar Association’s antitrust section.
