Seung-Hyeon (Alex) Kim is a senior foreign attorney (partner) on the international arbitration and litigation practice group at Bae, Kim & Lee, LLC in Seoul, Korea. He is one of the leading experts in the areas of international construction law and practice, BOT-type development projects, international commercial arbitration and cross-border litigation in Korea.

Prior to joining BKL in 2014, Alex worked as in-house counsel for over 17 years for several major construction companies in Korea including, among others, Samsung C&T Corporation and Hanwha Engineering and Construction Corporation. As in-house counsel, he gained valuable hands-on experience in not only reviewing overseas construction contracts and handling face-to-face contract negotiations, but also in resolving claims and disputes in a myriad of overseas construction projects. Drawing on this experience and expertise, Alex actively provides practical advice and guidance for clients in the international construction industry.

Alex participated in the first limited recourse project finance deal in Korea, the Pusan New Port Private Initiative BOT Project, which was selected as the Deal of the Year by the Asian Financial Times in 2003. He led the EPC contract negotiations with the syndication of onshore and offshore lenders based upon the FIDIC EPC/Turnkey Contract form (Silver Book) for the project. Alex’s extensive experience in project finance is further broadened by his handling of multiple international independent power projects (IPP) throughout the Middle East, Asia, South Asian and North Africa regions.

Since joining BKL in January 2014, Alex has been rapidly developing his expertise in international commercial arbitration by handling many arbitration cases under the rules of various arbitral institutions including, in particular, the ICC, SIAC, LCIA, and KCAB, focusing mainly on the international construction matters.

Alex received his law degrees from Seoul National University law school (LLB) in Korea and University of Washington law school (LLM) in the United States. He received MBA from Sungkyunkwan University graduate school of business. He obtained his Doctor of Laws (LLD) degree by presenting a doctoral dissertation entitled “A Study on the FIDIC International Standard Contracts” at the graduate school of law at the Seoul National University.

Alex has published a book titled International Construction Contracts: Law and Practice - mainly focusing upon FIDIC conditions, Pakyoungsa, 2015, which in 2016 won Sim-Dang Scholarly Achievement Award presented by the Korea International Trade Law Association. He was also honored to receive the first academic award presented by the Korean Research Institute of International Commerce and Law for his dissertation titled “A Study on Countermeasures against Unjust Claim for Independent Guarantee”, the Korean Research Institute of International Commerce and Law, 2016. He was also honorably invited to speak on the dispute adjudication board in FIDIC User’s Conference in Singapore.

In addition to his work as arbitration practitioner, Alex frequently lectures and speaks on overseas construction contract-related topics in Korea University and Sungkyunkwan University in Seoul, Korea.

Alex is licensed to practice in New York, and speaks Korean (native), English (fluent).
