Lukas Bühlmann heads the firm’s digital, data privacy and e-commerce group. After successfully completing his studies in Lausanne and Norwich, he gained experience as an associate in major Zurich law firms. Lukas also holds an LLM from the College of Europe (Bruges). In 2005, he set up his own practice and subsequently built up one of the first Swiss boutique law firms specialised in internet law. WHAT MADE YOU DECIDE TO GO INTO DIGITAL AND DATA LAW?

I have always been very interested in the intersection between the law and technology. Digitalisation does turn legal disciplines upside down in a way because it requires the combination of different areas of law that traditionally have not been practised by the same lawyers. At the same time, the problems to be solved are driven by the development of technology and a multi-jurisdictional context. Finally, as a lawyer in this area, you are at the forefront of development in society as well as business.

AS HEAD OF MEYERLUSTENBERGER LACHENAL’S DIGITAL, DATA PRIVACY AND E-COMMERCE GROUP, WHAT MAKES YOUR PRACTICE STAND OUT FROM THE COMPETITION IN THE MARKET?

We do not only have one of the largest teams of lawyers specialised and active in this practice area in Switzerland, we can also look back on more than 12 years’ focus on advising businesses with regard to their online activities. We have developed our specialisation alongside the development of digital business in Switzerland. Digitalisation has become such a driving force in almost all areas of business, with the consequence that our specialisation necessarily involves fast access to first-tier specialist know-how in other areas of the law, such as in particular IP, corporate and finance, and life sciences. MLL’s strong focus on IP-rich and technology-driven clients, together with the biggest team of specialised IP lawyers in Switzerland and a very prominent team of lawyers specialised in tech and fintech transactions allows us to understand and assist our clients perfectly, and bring together all the necessary know-how.

HOW HAS THE INCREASED AWARENESS FOR PRIVACY AND DATA PROTECTION CONCERNS IMPACTED ON YOUR PRACTICE?

The increasing importance of digitalisation has, of course, raised the awareness for the relevance of data protection law in all relevant business sectors. Data protection law has become one of the major disciplines in our practice. Even though the coming into force of the EU-GDPR was “the big peak” recently, I am convinced that this has not just been a temporary phenomenon. Digitalisation is all about data, which means that data protection and data security will naturally be a key concern for businesses as well as society and individuals. The need for advice in this respect will continuously increase at a fast pace. However, effective and pragmatic legal advice in this area does require combined specialist know-how – not just in data protection but also in all major areas of law relevant for the respective client’s business. Currently, many clients still reduce data law to a mere issue of compliance. This will change; it will develop into a much more strategic kind of legal advice, similar to tax or corporate structuring.

HOW DO YOU SEE THE RELEVANCE OF DATA LAW FOR COMPANIES IN ADVANCE OF AN ACQUISITION?

The “DD-readiness” does indeed include compliance with data protection and data security requirements in general and EU-GDPR in particular. This is particularly true for tech companies and start-ups. We clearly see that this has already developed into one of the major aspects in due diligence processes. Of course, the severe sanctions threatened by the GDPR in case of non-compliance have furthered this development recently.

YOUR FIRM IS THE ONLY SWISS FIRM WITH AN OFFICE IN BRUSSELS. WHAT ADVANTAGES DOES THIS ADD TO THE SERVICES YOU OFFER TO CLIENTS?

Whether you think of digital media, finance, fintech or life sciences, all sectors of business are being increasingly influenced by important regulation. This regulation is to a major extent driven by EU regulation, GDPR being a prominent recent example. Our presence in Brussels allows us to be closer to these developments and to assist and advise our clients from early on with regard to the impact on their operations.

YOU HAVE BEEN INVOLVED IN A NUMBER OF MAJOR CASES OVER THE YEARS. WHAT ADVICE WOULD YOU GIVE TO SOMEONE LOOKING TO BE IN YOUR POSITION IN THE FUTURE?

Stay open and curious for fast-changing legal regulation and new technologies. Lawyers too need to develop their “digital literacy” to keep up with this development. An understanding and interest in technology as well as interdisciplinary competence will be even more important in the future.
