Nichola advises corporates, directors and senior management on financial and corporate crime investigations and regulatory investigations. Key areas involve advising on and carrying out investigations relating to corporate collapse, corruption, sanctions, money laundering, terrorist financing, extradition, information security and fraud issues.

HOW WOULD YOU DESCRIBE YOUR PRACTICE?

A holistic and multidisciplinary approach to advising clients on the multitude of financial crime risks, looking at how you mitigate the risks through to the investigations piece. 

WHAT MADE YOU DECIDE ON A CAREER IN INVESTIGATIONS?

Luck. I was there at the beginning of the growth in corporate investigations work in the UK, more years ago than I care to remember. I count myself as incredibly lucky and have had great exposure to a varied and hugely interesting practice area.

YOU ARE WELL REGARDED FOR YOUR WORK IN THE CORPORATE AND FINANCIAL SECTORS. HOW HAVE YOU SEEN YOUR PRACTICE CHANGE SINCE THE FINANCIAL CRASH 10 YEARS AGO?

Growth! The approach I encourage our team to take is to look at the multiplicity of risks that the corporate faces. We have seen that strategy bear fruit.

AS SOMEONE WITH AN INTERNATIONAL PRACTICE, HOW HAS GLOBALISATION IMPACTED THE WAY THAT INVESTIGATIONS LAW IS PRACTISED AT THE NATIONAL LEVEL?

While not a new trend, the need to consider how investigations can be run in country, and the material shared; data protection, local employment law, data transfer, state secrets legislation... and then a decision as to which jurisdictions and to whom matters may need to be disclosed. 

The other key issue for me is how to manage the multiplicity of risks in investigations and how you manage these in multi-jurisdictional investigations.

WHAT ARE THE MAJOR MARKET TRENDS YOU ARE NOTICING IN THE INVESTIGATIONS SPACE AT THE MOMENT?

Concerns about privilege and the ability to be able to investigate the matter and keep such information privileged, while advising a corporate client about the risks they face and the measures they can take to protect the corporate, without the risk of having to share the information obtained. Why should a corporate client be in a different position to an individual client who comes to their lawyer and makes “a clean breast of it” to their lawyer? There is also a focus on certain geographical regions – India and Holland in particular.

COMPLIANCE REMAINS A HOT TOPIC IN THE FIELD. WHAT IS THE BEST THING PARTIES CAN DO TO MINIMISE THEIR RISK?

Investment into practical implementation. Tone from the top – both executive or senior leadership team and middle management.

AS HEAD OF GLOBAL INVESTIGATIONS AT ADDLESHAW GODDARD, HOW DO YOU PLAN TO DEVELOP YOUR PRACTICE OVER THE NEXT FEW YEARS?

For various reasons, it is key that we can deliver advice and solutions speedily and cost-efficiently. The growth in real-time communication and increasing globalisation of business have increased the speed of business and the multitude and number of sources of information that need to be reviewed before determining whether there is an issue, the size of the issue and the number of jurisdictions involved.  

We are looking at how technology and particularly AI can help deliver solutions quicker and more cost-effectively.

We also see that there will be a growth generally in the multiplicity of regulators looking at similar issues, so not just balancing multi-jurisdictional issues, but also the number of agencies and investigators involved.
