Jongkwan (Josh) Peck is a partner in the energy and M&A groups at Lee & Ko, and the leading nuclear lawyer in Korea.

Josh has represented Korea Electric Power Corporation, Korea Hydro Nuclear Power (KHNP) and Korea Plant Service and Engineering KPS (KEPCO) in all of their overseas nuclear power projects – notably the Barakah nuclear project in the UAE. Josh assisted KEPCO and its partners in the bid for the Barakah project, resulting in the surprise win for the Korean consortium, and led the negotiation of the prime contract. He has subsequently advised and represented KEPCO and KHNP in project implementation issues, and in the negotiation of the operation support services agreement and long-term maintenance agreement. Josh has also represented KHNP in the two-year bidding process and contract negotiations for the OL4 project in Finland, and is currently advising KEPCO in the bidding for the Saudi Arabia nuclear power project.

In the M&A and other corporate transactions area, Josh has represented foreign and Korean clients in numerous substantial transactions, including LG Chem in its acquisition of NanoH2O; LG Group in an investment into a Rolls-Royce subsidiary for fuel cell research and development; CH2M Hill in relation to the project management for the USFK base relocation project; MetLife in its proposed acquisition of Kumho Life; Woori Financial Holdings in the negotiation of a joint venture agreement with the Aviva Group for operation of its life insurance business; Munich Re in the acquisition of Daum Direct Insurance; LG Electronics in its sale of a 50 per cent share in its telecommunication systems business to Nortel Networks Limited; Boeing in its acquisition of shares in Huneed Technologies, a defence supply company; Korea First Bank in relation to the sale of its shares by Newbridge Capital to Standard Chartered Bank; Lotte Shopping in its licence agreement with Toys R Us; Shanda Interactive Entertainment in the acquisition of Actoz Soft; Hanwha L&C in the sale of Korea Independent Energy shares to Deutsche Bank; BNP Paribas in the negotiation of joint venture agreements with the Shinhan Group; Dongbu Group in the negotiation of a joint venture agreement with Evergreen; and PwC Consulting in the negotiation of an ERP consulting agreement with POSCO.  

Some of the major dispute resolution cases that Josh has handled include: representation of the Korea Deposit Insurance Corporation in a $150 billion ICC arbitration arising from an agreement for the sale of a major Korean bank; Sikorsky Aircraft in a product liability and wrongful death litigation, involving the crash of Black Hawk helicopter; shipowners, charterers, insurers, cargo owners and fisheries in hundreds of litigations involving ship collisions, grounding, oil spills, salvage and general average, charter party disputes and cargo damage, including the “Sea Prince” oil spill case; LS Cable in an ICC arbitration relating to construction work in Qatar; Pasteur Milk in a product liability litigation involving ice cream machinery; Samsung in an ICC arbitration involving a tax dispute relating to the Pusan new port project; and Honeywell in an ICC arbitration against a major auto maker involving product liability.

Josh holds a BS in management from Boston College and a JD from Georgetown University Law Center.
