Who's Who Legal Canada - Competition

Casey Halladay is a partner of McMillan LLP practising all areas of competition law, including merger clearance, cartel defence and private antitrust litigation. He has earned a diverse range of experience in this field, having practised with leading firms in Toronto, Washington and London. He is recognised as a leading lawyer by Chambers GlobalWho's Who Legal: CompetitionWho's Who Legal: Canada, Legal Media Group's Expert Guides and The Lexpert Guide to the Leading US/Canada Cross-Border Corporate Lawyers in Canada. He has been chosen by Global Competition Review as one of the top 40 competition lawyers in the world under the age of 40, and by Lexpert as one of the top 40 lawyers in Canada under 40. He is a two-time finalist for Global Competition Review’s award for Lawyer of the Year Under 40. Casey is also an active member of the leadership of both the ABA and CBA competition law sections.

Significant merger matters in which he has been involved include: Novartis/GSKTranscontinental/QuebecorAmerican Airlines/US AirwaysCF/ViterraWESCO/EECOLBHP Billiton/PotashABB/BaldorCoca-Cola Company/Coca-Cola EnterprisesSchlumberger/SmithOracle/PeopleSoftCarnival/PrincessBertelsmann/Zomba and Chevron/Texaco (Canadian reviews); Alcoa/Alcan (proposed), SFR/Télé2Deutsche Börse/Euronext (proposed), Alcoa/Orkla (ECMR reviews); Alcatel/Lucent (USA); and 3M/Biotrace (UK). Casey has also coordinated international merger clearances in various other jurisdictions worldwide.

In his cartel practice, Casey advises and defends companies and individual executives in respect of searches and “dawn raids”, negotiating and securing amnesty or leniency, cooperating with ongoing cartel investigations, and contesting allegations of misconduct before the courts. He has acted in numerous cartel matters in Canada, including aftermarket auto lights, auto parts (multiple retainers), automobile shipping, fine arts auctions, fine paper, LIBOR, packaged chlorine, polychloroprene, polyester staple fibre, rubber chemicals and semiconductor packaging, in addition to investigations in the US and EC. He regularly defends clients in follow-on class actions in Canada.

Casey has been involved in precedent-setting competition matters, including defending a corporation and individual executive in one of Canada's only contested bid-rigging prosecutions, winning dismissal of all charges on appeal to the Ontario Superior Court (R v Rowe et al, 2004) – ultimately prompting legislative amendments to the Competition Act. He also won leave to proceed, and interim supply, in one of the few private refusal-to-deal cases to come before the Competition Tribunal (UCDA v Insurance Bureau of Canada, 2012).

Casey advises potentially dominant companies on unilateral conduct issues, and represented Paramount Pictures in the Competition Bureau's investigation into the motion picture exhibition and distribution industry, and British Airways plc in the UK OFT investigation of BA's corporate rebating policies. Both investigations were abandoned by the regulators without any adverse findings against these clients.

Casey earned his LLB, summa cum laude, from the University of Ottawa and his LLM from Harvard Law School, where his LLM paper on competitor collaborations under the Sherman Act was chosen as a finalist in the international Swope Antitrust Writing Competition. A native speaker of English, Casey also speaks Italian and French, and has a conversational grasp of Russian and Bulgarian. He is a member of the bars of Ontario, New York, and England and Wales.

WWL says: Casey Halladay is widely respected by respondents for his superb experience hanlding sophisticated cartel defence and merger clearance matters for clients.
