Daniel Ayotte specialises in litigation, arbitration and mediation. His practice involves mainly construction claims, product liability, professional liability and commercial litigation. Daniel represents multinational corporations, contractors, engineering firms, manufacturers, insurers and bonding companies. He handles complex litigation matters and pleads before all civil courts and tribunals.

For several years, Daniel acted as legal counsel in an important construction dispute brought before the Iran-US Arbitration Tribunal sitting at The Hague. He successfully pleaded several landmark cases including Bank of Montreal v Commission Hydroélectrique du Québec et al., in which the Supreme Court of Canada defined the duty to inform in contractual matters arising from the general obligation to act in good faith, Walsh & Brais inc v Montréal (Communauté urbaine de) REJB 2001-26438 (C.A.), Birdair v Danny’s Construction Company inc, 2013 QCCA 580 and Hydro-Québec v Construction Kiewit Cie, 2014 QCCA 947, where the Quebec Court of Appeal defined the duty to cooperate in construction contracts.

Daniel Ayotte is the author of several articles dealing with construction law, professional civil liability and mediation. He is a guest speaker for professional associations, contractors, the Association de la construction du Québec and many other entities. He has served as a guest professor at McGill University.

He is recognised as a leading infrastructure lawyer in the 2014 Lexpert Special Edition on Infrastructure and is listed in the 2016 edition of Who’s Who Legal: Construction and the 2016 edition of Who’s Who Legal: Canada (construction). He was selected by peers for inclusion in the 2016 edition of The Best Lawyers in Canada (construction law, legal malpractice law) and has been included since 2006. He was named “Construction Lawyer of the Year – Montréal” in the 2010 edition of Best Lawyers. He has been recognised annually (since 2001) in the Lexpert/American Lawyer Guide to the Leading 500 Lawyers in Canada; is also recognised in the 2016 edition of Chambers Global, The Canadian Legal Lexpert Directory (construction law) and is Martindale-Hubble Peer Review Rated.
