Andrzej Kmiecik is a partner in Van Bael & Bellis’ Brussels office. His practice focuses on all aspects of competition law, with particular expertise in merger control proceedings, cartel cases and investigations in the field of distribution and licensing, as well as pricing, intellectual property and state aid matters. He represents clients before the European Commission, the EU Courts and in national competition law proceedings.

Andrzej’s practice covers a wide range of sectors, including automotive products, pharmaceuticals, paper and board products, office equipment, consumer electronics, aerospace, petrochemicals, clothing and footwear, and financial markets.

He has handled such high-profile EU merger control cases as Boeing/McDonnell Douglas; Enso/Stora; Boeing/Hughes; Caemi/Mitsui/CVRD; Boeing/Lockheed/ULA; SABIC/Huntsman; SABIC/GE Plastics; DFDS/CRO Ports/Älvsborg; Canon/IRIS (Art 22 referral); and London Stock Exchange/Deutsche Börse (for complainant). He has also acted as defence counsel in a range of EU cartel investigations (such as Newsprint, Fine Papers and Occupant Safety Systems) and has successfully defended clients against complaints of exclusionary conduct before the European Commission (including Canon and Honda).

Andrzej’s experience extends to acting as counsel in major EU antitrust investigations involving the life sciences sector, including Becton Dickinson/Novo Nordisk; Lederle/SKB; and Chiron/DRK. He was actively involved in the Commission’s pharmaceutical sector inquiry.

He has also developed a niche practice in the field of motor vehicle distribution. He counsels and defends a number of manufacturers, combining extensive experience with in-depth industry knowledge.

Andrzej regularly lectures and writes on competition law matters and is the coordinating contributor to Van Bael & Bellis’ leading treatise Competition Law of the European Community (Kluwer, fifth edition), a standard work of reference in the field of EU competition law now in its fifth edition. He has been recognised as a leading practitioner in his field by many legal directories, including Chambers Global, Chambers Europe, Expert Guides, The Legal 500, IFLR1000 and Best Lawyers.

Andrzej completed his MA at Merton College, Oxford University. He also studied at the College of Law in London and received his diploma in European law from the College of Europe. He is qualified as a solicitor in England and Wales and is a member of the Brussels Bar.
