Who's Who Legal Arbitration: Lawyers

Emmanuel Gaillard heads Shearman & Sterling’s 100-lawyer international arbitration practice.

He acts as counsel and arbitrator in commercial and investment treaty arbitrations. He is regarded as a leading authority in both those fields worldwide.

Emmanuel Gaillard has appeared as counsel in many of the largest and most sensitive energy, investment, M&A and construction disputes submitted to arbitration. Those include the arbitrations brought by the majority shareholders of the former Yukos Oil Company against Russia, which led to a US$50 billion award in favour of the shareholders, the arbitration brought by the Dow Chemical Company against a Kuwaiti company in relation to a failed joint venture, which led to a US$2.47 billion award in favour of Dow, and numerous matters brought against the Arab Republic of Egypt and its national energy companies following the 2011 Egyptian Revolution.

A professor of law in France and a visiting professor of law at Yale Law School and Harvard Law School, he has written extensively on all aspects of arbitration law. His publications include a seminal treatise (Fouchard Gaillard Goldman On International Commercial Arbitration) (co-author), the first essay on the Legal Theory of International Arbitration, available in English, French, Arabic, Chinese, Spanish and other languages, and the UNCITRAL Secretariat Guide on the Convention on the Recognition and Enforcement of Arbitral Awards (co-author), available in all UN languages.

Emmanuel Gaillard served as a member of the ICSID panel of arbitrators, appointed by France. He chairs the International Arbitration Institute (IAI) and was the first president and one of the co-founders of the International Academy for Arbitration Law.

WWL says: Emmanuel Gaillard “is a clear leader in his field” of commercial and investment treaty arbitration and is widely endorsed as “a major and deeply influential player”.
