Olivier Hari is of counsel in Schellenberg Wittmer’s corporate and commercial, mergers and acquisitions, capital markets and restructuring and insolvency groups, and is also a professor of law.
Olivier is highly specialised in all corporate matters, with a special focus on restructurings and insolvency (which include corporate insolvency and restructuring, financing and refinancing of distressed businesses, distressed M&A, litigation proceedings, being cross-border or not). He has a wide range of professional skills in complex corporate matters and related litigation areas, advising shareholders, board members, banks, creditors and companies. Besides this, he is also regularly appointed by courts to monitor and support distressed companies. His personal experience as board member allows him to better understand the expectations of directors and other business leaders from more than just a legal perspective.
Some recent examples of his work in restructuring and insolvency include: Swiss counsel in a complex cross-border restructuring including a syndicated trade finance arrangement; Swiss counsel of a secured creditor in a restructuring of an international group of companies; and acting as a member of an informal team in charge of analysing the impact and adequacy of an urgent law drafted by the Swiss Federal Council for covid-19 distressed businesses.
