Nigel chairs the Ashurst competition and antitrust law practice. Admitted in Ireland and England & Wales, Nigel specialises in all aspects of UK and EU competition law, including mergers, strategic business advice and competition risk management, cartel and abuse of dominance cases, market/sector investigations, appeals and competition litigation. He has LLB, LLM and PhD degrees in Law and EU Law, and is the co-author of UK Merger Control: Law and Practice (3rd edn, Sweet & Maxwell). He is based in both London and Dublin.
His recent matters include: IHSMarkit, in relation to its $44bn merger with S&P Global; Circle Healthcare in relation to its acquisition of BMI Healthcare; Lloyds Banking Group, in relation to the introduction of "Open Banking" in the UK following the CMA's market investigation; Royal Mail Group on the first Competition Act infringement decision taken by Ofcom, its appeal to the CAT and subsequent appeal to the Court of Appeal; Application Developers' in relation to the appeal of the EU Commission's Android Decision to the EU General Court; and Arla Foods in relation to the acquisition of the organic milk and butter business of Yeo Valley. He is advising a number of clients in relation to Brexit-related issues, as well as in connection with the response of competition law to the Covid-19 pandemic, and in particular the adoption of three statutory Orders (private healthcare, groceries and dairy) which excluded the application of competition law to those sectors.
