Nicola Swan is a partner at Chapman Tripp specialising in international commercial arbitration and litigation, investor-state disputes, public international law (PIL) and climate risk; with a focus in the energy, extractive, private equity, telecoms and finance sectors. Nicola leads Chapman Tripp’s international law practice. Nicola is a Fellow of the Chartered Institute of Arbitrators (London) and the Arbitrators and Mediators Institute of New Zealand. Nicola is currently acting from New Zealand on international arbitration and ICSID matters as well as public law and international human rights matters. Nicola regularly advises on climate-related litigation and legal risk.
While in London, Nicola was International Counsel at Debevoise & Plimpton LLP focusing on international commercial and investor-state arbitration. She worked with teams in London, Paris and New York acting for a publicly-listed mining company against an African government in a multibillion dollar UNCITRAL arbitration seated in London, a private equity firm in a dispute under ICC Rules, a global services firm in a Belgian-seated post-M&A dispute; and an arbitration disputing PIL obligations brought under a Headquarters Agreement with a host state. Nicola acted on international human rights matters before the ECHR, the African Commission, UK Supreme Court, and courts in Singapore and Belize.
Nicola is a member of the IBA’s Arbitration Committee ESG Working Group and appointed as an expert adviser on climate change to the UK Government. Nicola was a member of, and secretary to the ICC’s Task Force on Arbitration of Climate-related Disputes the ICC’s Task Force on Witness Testimony, and was a founding board member of the Young Public International Law Group.
