Biography

Marcelo is one of the first lawyers entirely devoted to environmental law in Brazil, with almost 25 years in the field.

He has a strong performance in environmental law litigation and consulting, working in several sectors of the economy, such as infrastructure, oil and gas, food, real state, ports, shipbuilding, urbanization, energy, mining, cellulose, biodiversity and genetic resources, and others.

Besides that, Marcelo holds an extensive experience on regulatory matters, environmental permits, solid waste, sustainability, atmospheric emissions, payments for ecosystem services, REDD and due diligence, providing an argumentative and critical view of these increasingly demanding issues.

He is considered a great litigator with cases all over the country, including the Superior Courts, defending companies in public civil actions, citizen actions and analogous. He is also frequently searched to help clients in settlements, especially in hard cases.

Advising in licensing processes is also a very important skill he presents, with great results over the years.

In the academic field, he has received an LLM and an SJD in diffuse and collective rights from the Pontifical Catholic University of São Paulo. He was a visiting scholar at Elisabeth Haub School of Law at Pace (White Plains/NY). He has a postdoctorate in environmental law, transnationality and sustainability from the University of Itajaí (UNIVALI), where he is a well-known environmental law professor in LLM and SJD. Marcelo is formally a visiting professor at the University of Alicante, in Spain, and at Widener University Delaware Law School, in the US.

He is also a well-recognised lecturer in Brazil and abroad. His teaching experience includes classes for public prosecutors, judges and public and private attorneys.

Marcelo is author, organiser and editor of more than 30 books, including:  Ação Civil Pública e Meio Ambiente ("Public Civil Action and the Environment"), Direito Ambiental de Conflitos ("Conflicts in Environmental Law"), Código Florestal anotado (“Notes on the Forest Code) and Leading cases ambientais analisados pela doutrina (Environmental leading cases examined by specialists). He has also written around 100 articles published in books and journals in Brazil and abroad, including a contribution in “Implementing Environmental Constitutionalism” (Daly, Erin; May, James (Editors). Cambridge University Press, 2018).

Marcelo is a member of the environmental law committee of the Brazilian Bar Association and of the commission on environmental law of the Brazilian Lawyers Institute.

Marcelo has an LLM and an SJD in diffuse and collective rights from the Pontifical Catholic University (PUC) of São Paulo. In 2012, he was a visiting scholar of the environmental law programme at Pace University School of Law (White Plains, New York); and in 2015, a scholar-in-residence at Widener University Delaware Law School.

He has a doctorate in environmental law, transnationality and sustainability from the University of Itajaí (UNIVALI). He is a well-known environmental law professor in Brazil, teaching and convening courses at various universities throughout the country (PUC in São Paulo and Rio de Janeiro, Universidade do Vale do Rio dos Sinos, Cesusc, etc). In 2017 he formally became a visiting professor at the University of Alicante, in Spain, where he has been lecturing since 2012. In 2018, he took on the same position at Widener University Delaware Law School.

He is also a well-recognised lecturer in Brazil and abroad. His teaching experience includes classes for public prosecutors, judges and public and private attorneys.
