Jeffrey E Fuchs, PE, CPA, chief executive officer and co-founder of Delta Consulting Group, has over 35 years of experience in the engineering and construction industries. His expertise includes analysis and resolution of contract disputes, including schedule and delay analyses, quantum calculations, and productivity impacts; forensic engineering and accounting; and expert witness testimony. Mr Fuchs has a BS in civil engineering and a MS construction engineering and management from the University of Maryland.

Delta Consulting Group is celebrating 20 years this year. What did you enjoy most about establishing your firm? 

In April of 2000 when Mark Dungan and I decided to start Delta, we were committed to providing cost-effective, high-quality work product for our clients, while creating a team-oriented, hardworking, friendly culture for our employees. Over the years, our two-person firm has grown to over 60 experts who are working on complex projects throughout the world. I have most enjoyed being part of this growth and seeing Delta’s reputation flourish. 

You have testified in a lot of high-profile construction cases. What were some of the interesting non-construction cases in which you testified?

Two of the most interesting non-construction cases I worked on involved an international telecommunications satellite and a massive class-action matter. The satellite case was a $1billion project between a very large UK and US entity. This was a very complex damages case that involved highly technical issues as well as a lost profits analysis. The class-action case involved a lawsuit alleging that a major defence contractor misled investors by not disclosing losses on numerous large construction projects worldwide. At the time, the nearly half a billion-dollar settlement was the tenth largest in the history of class-action litigation cases against a major corporation. Both cases were very challenging and successful for our clients.

What qualities are important to be an effective construction expert?

Having just recently hired several very qualified experts this year, we were really looking for those individuals who have a strong initiative to further their career. In this business, things are constantly changing. There is always new software or methodology to master, and no two cases are alike. Delta looks for those who yearn to be the best experts, those who want to become pioneers in these growing environments. In January of this year we could not have predicted that our firm would be involved in many virtual depositions, trials and arbitrations in several countries. The most effective construction experts must be smart, adaptable, a team player and have the “fire in their belly” to be the best.

In what ways has covid-19 impacted Delta’s employees and their client’s ability to work together on projects?

Based on our employee-client relationships, nothing has changed at all. We are still communicating and working with our clients daily, the same as we were before covid-19. It is unfortunate that we have not been able to have in-person meetings and present at hearings and trials, but thankfully state-of-the-art technology has lessened this inconvenience and has kept our client relationships unaffected. Working efficiently and effectively from anywhere has been part of our job for many, many years.

What advice do you give to younger-in-career experts who want to become testifiers? What type of mentoring does Delta provide?

Delta focuses heavily on mentoring and training our employees. We hope that every employee who joins Delta has a long, successful career here. In fact, one of our core values is providing fertile ground for growth. We have strategic leadership teams that meet every month to go over new techniques, methods, software, etc. We foster a sharing, team-oriented approach to mentoring, instead of assigning new employees to one mentor. One junior person who is based out of our UK office could be working on a nuclear power plant job with experts in Virginia, and a massive canal project with experts in Florida. We believe working with many experts on a variety of jobs deepens their experience and gives them different perspectives that will help them become better testifiers. 

What is it about being an expert witness that you enjoy the most?

I love the challenge of working with a diverse set of clients, cases and employees. You must always be engaged and focused as an expert witness, which makes the job exciting. Additionally, watching others grow at Delta brings me great joy. It has been very rewarding watching these experts succeed and create their own client relationships.

In what ways has coronavirus impacted your work, the construction market, and how do you envisage the market changing as a result? 

Fortunately, several years ago we enhanced our hardware and software, which allows our consultants to work remotely from anywhere, at any time, around the world. As a result, our experts and clients have not experienced any interruptions due to covid-19. We also have a strong team environment at Delta, so we have not felt any negative impact on our ability to work together on projects. 

One of the biggest changes we have experienced during this pandemic has been that several of our litigation and arbitration cases were converted to virtual depositions, trials, and hearings. We have also been asked to provide project advisory services to clients who have experienced delays and disruptions due to covid-19. Last month, I had an ICC virtual hearing. I found it to be very efficient and cost effective. Anyone who has been involved in a construction proceeding knows the costs in terms of time and expense are substantial. 

Certainly, in some cases, I can see virtual options being included in the future. In addition, I believe increased project advisory work on construction sites is going to continue for quite some time. We have a lot of clients who are seeking advice regarding how to turn their project around and prove or mitigate impacts. 

What is the key to becoming a successful expert witness in large-scale, high-profile construction disputes? 

Learning how to listen and communicate effectively are really the keys to success. You can help your career by adding construction experience and certifications, but as an expert you must be able to explain your findings to your clients and their lawyers, and then to a judge, jury, or arbitration panel. My PE and CPA licenses have always been important because they add to my credibility, as both have strict Codes of Ethics that the person is required to adhere to. On big disputes you have to be a good listener in order to understand and flush out the issues and know the important questions to ask. However, clients and their lawyers, especially on high-profile cases, want an expert who will review all the relevant facts concerning the case, analyse them thoroughly, and then clearly and concisely explain the case. When you are on the stand, you must be able to engage and sustain the interest of all parties.

Early in your career you worked at one of the Big Four and with construction companies. Why did you decide to switch over to expert witness testimony?

The challenge. I enjoy working with many different types of clients and lawyers on cases involving delays, damages, and loss of productivity issues. As a testifier, I have been on construction sites around the world and I have experienced first-hand, complex projects being constructed under varying laws and restrictions. It has been a fascinating career. When I was first testifying, I also realized that I could make a difference for my clients. Knowing that my ability to understand, analyse, and present the facts of the case, could be the deciding factor in the outcome, is exciting and challenging to me.

Delta has experienced a lot of growth over the past few years. Why do people want to work at Delta; what distinguishes you from your competitors? 

Our employees tell me that they love working at Delta because of the people who work here. We have a culture that is built on caring about our employees and our clients. If we are working on a mega job in Chile or a complex rail project in California, everyone wants to “make the difference” for our clients on that job. When Mark Dungan and I founded Delta 20 years ago, our vision was to create an environment that would be a “fertile ground” for growth for our employees. We have enjoyed giving our younger employees the tools and mentorship that is needed to learn and grow. We sought to build a company that had a team oriented, hardworking, friendly culture with a focus on continuous improvement. I believe we have accomplished that at Delta; and that is what sets us apart.

What are the greatest challenges an expert faces when preparing for an arbitration proceeding?

In arbitration, the expert’s testimony often will make or break a case. On large construction projects, it takes a considerable amount of time to comb through the data, extract the key facts, and then analyse that information correctly. This is something Delta has exceeded in by staying up to date on new technology and providing these tools to our employees. If our client has good records, we have been able to greatly improve the data extraction and analysis time with the use of advanced specialized software. This has been a big advantage for our clients. 

Also, over the years, I have found that the more successful arbitration lawyers know and understand the incredible value the expert testifier brings to the proceeding. They will ensure these challenges are mitigated and the experts are retained early on.

You have enjoyed a very distinguished career so far. How do you see your practice evolving over the next five years?

I thoroughly enjoy testifying on large litigation and arbitration cases throughout the world, so I hope to continue working on these types of projects. I especially like the complexities of the mega construction jobs that have a combination of damages, delays, and productivity issues. These cases often allow me the opportunity to introduce our clients to the incredible talent that we have mentored and trained over the years at Delta. The strength of our company is in the next generation and I really enjoy working with our younger experts on these complex jobs. I find the dual role of expert and mentor to be very rewarding and it is a great benefit for our clients to have a new generation of testifiers with this level of expertise working on their jobs.
