Jeffrey E Fuchs, PE, CPA, president and co-founder of Delta Consulting Group, has over 35 years of experience in the engineering and construction industries. His expertise includes analysis and resolution of contract disputes (including schedule and delay analyses, quantum calculations, and productivity impacts); forensic engineering and accounting; and expert witness testimony. Mr Fuchs has a BS in civil engineering and an MS in construction engineering and management from the University of Maryland.

As president of Delta, how do you see your firm’s large-scale international practice growing over the next five to 10 years?

We have a robust business plan to continue the expansion of our international practice. Our plan includes hiring experts from a broad and diverse background including native Spanish, Portuguese, Chinese, Arabic, Kurdish, and German speakers. In addition, we encourage all personnel to further their understanding of languages and cultures. This year we opened a London office, which strengthened our international presence and allowed our experts to provide additional, complementary services to our clients. In addition, we have seen considerable growth in our Latin American practice. Delta’s Latin American experts have testified in many of the largest international arbitrations in the world. Four of our experts work predominantly on these arbitrations where Spanish is the predominant language of the documents, witnesses and testimony.

What do clients look for in an effective construction expert?

The most important quality is hiring an expert who will be objective and independent. However, it is also important for them to look for an expert who knows the construction industry and has the appropriate education and experience for the job. Often, I have found that if an expert has experience with the full cycle of a construction job, they will understand what can go wrong. This can save a client valuable time and money. In addition, the expert needs to be a great communicator. Because once the expert determines the facts, they must be able to articulate them to the client as well as the arbitrators.

Looking back over your career, what is the most interesting case that you worked on?

I have always enjoyed complex mega-projects with disputes that are over US$1 billion. Last year I worked on two significant matters that involved the Panama Canal. One was the expansion of the canal, and the other was the Atlantic Bridge that spans across the canal at the Atlantic entrance. These massive billion-dollar disputes are interesting because they typically involve many aspects of a dispute. As an example, on the bridge we provided expert reports and testified on the quantum, delay, risk analysis, and loss of productivity – using four different Delta experts. This type of job is very rewarding because, not only do I have an opportunity to testify, I also get to see younger Delta experts testify on these massive cases.

What do you enjoy most about your work?

As a PE and CPA, I have been able to testify on both quantum and delay on very challenging construction and commercial damages cases. This has allowed me to have a lot of variety on interesting cases throughout my career. In addition, I’ve also enjoyed building Delta Consulting Group into a worldwide consulting firm. Being recognised by GAR as a Power 30 firm, the sixth largest in construction and the 10th largest in energy arbitrations, helped confirmed that our vision has become a reality. When Mark Dungan and I established Delta, almost 20 years ago, we made a commitment to three core values: providing clients with top-quality services; creating “fertile ground for growth” for our employees; and straightforward honesty and integrity in everything we do. It’s extremely rewarding to see that we are “making the difference” for our clients.

What measures do you take to ensure you provide clients with quality service?

Delta has always been committed to providing our clients with top-quality services. About two years ago, we established strategic leadership teams. These teams have become highly effective management groups that provide the structure for training our younger-in-their-career professionals, encouraging collaboration and sharing at “lessons learned” lunch sessions. In addition, they provide a forum for executing peer reviews, developing and improving standards, and identifying new software, to name a few. Since the formation of these groups we have found that our experts are becoming “a mile deep” (learning and sharing current cases, trends, software, etc), which in turn allows them to provide high-quality services for our clients.

As president of Delta Consulting Group, what are your main priorities for Delta’s development over the next five years?

We have a robust business plan for growth that includes a strong commitment to maintaining our culture and quality work product on every job for every client. One aspect of the plan is to continue the expansion of our international practice. While our current strengths are in the US, Europe and Latin America, we are developing additional alliances in the Middle East and China. Because we can handle so many components of a case, growing worldwide is a natural path for Delta.

What do you enjoy most about working in the construction sector?

Recently I have really enjoyed working on complex and challenging mega-projects with disputes that are over US$1 billion. I have always appreciated working in a variety of industries, including power, heavy civil, industrial facilities, oil and gas, large commercial projects, and transportation. This past year I worked on a complex matter involving the expansion of the Panama Canal, which I found to be very interesting. My experience and education allow me to testify on cases involving delay, loss of productivity, and quantum analysis. I thoroughly enjoy this diversity in my work.

How does Delta Consulting Group distinguish itself from competitors?

Delta Consulting Group enjoys a world-class presence in the market. According to the GAR 100 (2019), Delta is ranked sixth in the world for total number of construction arbitrations, and 10th in energy arbitrations. Delta is one of the few consulting firms that can truly provide a full range of construction project management oversight and litigation/arbitration services to our clients. One thing I am particularly proud of is that the majority of our experts have testifying experience and they bring a breadth of experience and knowledge to matters involving loss of productivity, schedule and delay analysis, and quantum/damages.

Delta recently announced the opening of its London office – what opportunities does this expansion create for the group?

Delta has been representing clients in Europe for nearly two decades. Our new London office strengthens our international presence and allows our experts to provide additional, complementary services to our clients in London, Europe and the Middle East. Delta has brought together an exceptional group of experts who are the very best in their field. Our new consultants are highly skilled and experienced in numerous sectors including infrastructure, major roadworks, structures, rail, petrochemical, sewage works, power, hospitals, workplace and education.

What has been your greatest achievement to date?

My greatest achievement to date is co-founding and growing Delta Consulting Group into a worldwide consulting firm. We work to win as a team. We are each passionate about what we do; however, collaboration is ensconced in our mindset. I’m proud that we have built a highly credentialled team that respects each other, and we support an environment of kindness, openness and honesty. With numerous advanced degrees and licences in engineering, accounting and construction (many are licensed professional engineers and certified public accountants), the majority of our professional team has served as expert witness testifiers.
