Biography

Jay Terkiana is founder and managing immigration attorney at Terkiana, Inc, a law firm based in Silicon Valley, California, handling employment, family, business, asylum/removal, and complex immigration matters. In words of Jay Terkiana: 

"For me it was never about volume or having a purely transactional practice, because that felt just too easy – it is just rinsing, repeating, delegating work to paralegals, editing/updating, and boasting blogs/credentials on social media. I did not want to participate in that race. It was old school and not as interesting as handling complex cases. I did not want to just sit in fancy offices, behind fancy mahogany desks, in fancy suits, dealing with only one administrative agency (USCIS) all my life, and call it a career. I quit my position in Manhattan, New York and moved to California to explore more. I knew that I could do much more – just because of following factors – that I am an immigrant, I have personally gone through the employment-based immigration process myself for 10+ years, I connect to immigrants better, and most importantly I really love immigration. 

"It was obvious for me to not limit my immigration practice to just employment immigration. So, I delved into family immigration, removal/deportation, and complex immigration practice. I started assisting clients from all segments of society and all corners of world, that included students who just arrived to the US, tech employees, tech companies, start-ups, small employers, small businesses, entrepreneurs, asylees/refugees, victims of crimes, extraordinary ability professionals, scientists, athletes, religious workers, domestic violence victims, and many more. 

"Now that I look back, I realise that I have come too far. However, I never forget the fact that I am an immigrant, who came to the United States as an F-1 international student in 2007 to study law at Saint Louis University in Missouri, USA. I came to the US with only two suitcase of belongings and had to navigate the entire immigration process myself, while all the odds were stacked against me. After graduating I did not know what to do, who to call, where to go. I packed my two bags and moved to California with less than $100 left in my pocket. I worked very hard, secured a job, passed the bar, and became an immigration lawyer. However, because of long immigration waiting lines for Indian nationals and discriminatory per-country limitation rules, it would take me another 10+ years to receive my US permanent residency. I had to go through student visa/OPT, work visa/H-1B, several visa extensions, visa transfers through different employers across different states, green card filing, and several other struggles which are generally a part of an immigrant's journey. This immigrants journey taught me compassion, patience, hard work, and helped me grow as a person. I fell in love with this country (United States) and all the opportunities it has provided me. After working for over 10 years at several law firms in United States, I opened my own law firm in 2018 in Silicon Valley, California. For me practicing immigration law is not just a business. IT’S PERSONAL!

So far over a period of over 10 years, Jay Terkiana, has assisted several thousand clients (including individuals, start-ups, small businesses and large corporations) in almost every type of visa application. Jay has assisted corporate clients with employment-based immigration cases: specially H-1B, L-1A, L-1B, EB-1A, EB-1B, EB-1C, National Interest Waivers (NIW), O-1, EB-2/EB-3 PERM, EB-5, TN, E-1/E-2, R-1, P visa, adjustment of status/green cards, assistance during Department of Labor (DOL)/USCIS site visits, I-9 compliance, handling DOL and immigration audits, and assisting in lawsuits arising from benching/back-wages claims/and other alleged immigration violations. Jay has assisted individual clients facing very complex issues like unlawful presence/out of status issues, inadmissibility, reinstatement of status, u-visas, VAWA, asylum, deportation, 3/10-year bar, Humanitarian reinstatements, answering Request for Evidence (RFE), assistance with 601/601A hardship & inadmissibility waivers, I-751 removal of conditions, filing Motion to Reopen (MTR) or appeal against the denials, and criminal convictions with severe immigration consequences. In addition to representing clients before USCIS, he also represents clients before Asylum Office, Immigration Courts, Administrative Appeals Office, Board of Immigration Appeals, and US Circuit Court of Appeals. Over the years, Jay Terkiana has developed a strong expertise in successfully handling some of the most challenging immigration cases, conducting compliance consultations, defending government audits and related litigation.
