Biography

Jacqui Record is a senior managing director at Ankura with expertise in disputes and investigations. She is based in Dubai and has been in the Middle East for the past nine years. Jacqui was previously the head of Deloitte’s Middle East disputes practice and has more than 25 years of litigation and forensic investigation experience in UK, Europe, the Middle East and Africa. She has provided expert evidence over 50 times in a wide variety of forums around the world and is listed in WWL’s list of worldwide recognised experts.

In terms of her professional experience Jacqui has been appointed in the following capacities: by the respondent to provide an expert witness report and testimony in a dispute between a UAE oil and gas manufacturer and a contractor due to the delayed completion of the construction project; to provide forensic investigation and dispute advisory assistance to a large Middle East parastatal regarding funds recovery related to large scale misappropriation by senior management; as an expert in a large shareholder dispute before the Center for Amicable Settlement of Disputes in Dubai; as Dubai Supreme Court expert in a large shareholder dispute for a multinational family owned business group; as an expert for the claimant in a DIAC arbitration to assess the loss of profit on the delay in the operation of a hotel; as an expert for the respondent in a Qatar arbitration to assess the loss of profit on the termination of an asset operation agreement

Jacqui has alse been appointed as an expert for the respondent, a Middle East property developer, in an ICC UK matter to assess the loss of profit claim due to the cancellation of a marketing agreement; as an expert for the claimant on a BIT matter regarding the loss of land use for a European logistics entity; as an expert for the claimant, a Middle East oil and gas entity, in an ICC UK matter to assess quantum on a terminated infrastructure project; as expert acting for the claimant in a DIAC arbitration matter regarding the early termination of a processing plant project in Africa assessing loss of profits, actual costs, and settlement agreements for suppliers; to provide a dispute advisory for a large family group in the UAE to assist with a claim before the Dubai courts with a value more than 1 billion dirhams, and to assist the client in presenting arguments and financial information to the court-appointed accounting expert; as a tribunal-appointed expert for a dispute between a Middle East telecoms operator and US service provider to assess the quantum of losses; as an expert on a UK construction adjudication matter to assess the calculation of claims for variations in the contract for a large transport parastatal; and as expert assessor assisting the Public Protector regarding the highly publicised Strategic Fuel Fund investigation, with work including verbal and written reporting to Parliament on two separate occasions.

She has also acted in an investigation/dispute advisory capacity regarding potential claims on a multibillion-dollar transport infrastructure project including cash flow and cost reviews; on an investigation engagement in Jordan, assessing allegations for fraud and misuse of position against the former CEO of a large parastatal company, with losses valued at more than $100 million; and in a forensic investigation for a European construction company into irregularities at its Dubai subsidiary, including financial statement reconstruction.

Biography

Jacqui Record is a senior managing director at Ankura heading the Disputes & Investigation practice for EMEA and APAC and has been based in Dubai for the past eleven years.  She is a UK chartered accountant (Fellow of the ICAEW) and  has more than 25 years of broad litigation and forensic investigation experience mainly within the Big 4 across the UK, Europe, Middle East and Africa. She has provided expert evidence over 50 times in a wide variety of forums around the world.

As an accounting expert witness in the Construction area Jacqui’s key areas of expertise have related to Oil & Gas and broad infrastructure, Hospitality and Leisure and Residential. Whilst her work has been predominantly focused on international arbitration, she has also acted as an Expert Assessor and has been appointed on a number of large local Arabic court matters, as both a court appointed and party appointed expert assisted by her Arabic team.

She is a UK chartered accountant  (Fellow of the ICAEW) and has more than 25 years of broad forensic investigation and litigation experience mainly within the Big 4 across the UK, Europe, Middle East and Africa. She has been based in Dubai, Middle East for the past eleven years.

As a forensic accountant, she has managed multi-faceted investigations for a wide variety of government, parastatal and commercial clients covering both financial and non-financial services sectors.  She has worked on some of the largest global forensic investigations reporting to the US DOJ and other international government regulatory bodies.  She has had a particular focus on sanctions, shareholder, oil & gas, construction/real estate and JV/distributor investigations.

Her investigations utilize the latest forensic technology and asset recovery specialists coupled with a deep understanding of people and accounting issues.  She is has testified more than 70 times in both criminal and civil matters in a wide variety of forums.  She has also been appointed as a local senior court-appointed expert in the Middle East on high- value fraud matters assisted by her Arabic team and an expert assessor on a high-profile government fraud investigation.  As such she is uniquely positioned to manage the investigation from identifying the initial risk factors through to financial statement reconstruction, asset recovery and criminal prosecution working across jurisdictions and criminal and civil actions to arrive at the best outcome for the client.

Some examples of her key investigations include investigations relating to major high profile frauds.
