Hwan Sung Park is a standout lawyer who wins effusive praise from commentators for his excellent work on unfair competition, domain name disputes and trade secrets issues.
Hwan Sung Park is regarded as one of the brightest legal analysts in Korea. As a member of the corporate practice group in his earlier years of practice, he counselled prominent foreign and domestic clients in several high-profile M&A deals. But as his practice has become more focused on intellectual property (IP) and information technology, Mr Park has represented and counselled major IP and IT companies in connection with patents, trademarks, trade secrets, unfair competition, copyrights and domain names.
In this capacity, Mr Park has been involved in a number of landmark IP cases including, for example, the first “functional drawing copyright” lawsuit in the history of Korean jurisprudence. Moreover, drawing from his experience in advising clients on M&A transactions, he also provides strategic advice on IP matters including IP portfolio management; abuse of IP rights issues; establishment and management of non-practising entities (NPEs) and countermeasures against NPEs; IP transactions; and IP financing, with a keen awareness of his clients’ corporate objectives.
Further, having collaborated closely with many foreign law firms in service of mutual clients, Mr Park is well versed in IP litigation in foreign jurisdictions, including the US courts and the ITC. His unparallelled experience has allowed him to counsel domestic clients in foreign legal proceedings from many different strategic angles and, more importantly, manage multi-jurisdictional litigations in the most effective manner. Concurrently, Mr Park advises clients on streamlining document management and pretrial discovery processes, which are critical in any phase of foreign (especially US) litigation proceedings. Leveraging his unrivalled expertise in this area of legal practice, Mr Park helps both foreign and domestic clients in ensuring that they remain at all times in compliance with legal and regulatory requirements in the face of any future litigation or investigation by government authorities.
Mr Park is also an expert in IP surveillance and border enforcement with in-depth knowledge of the proceedings before the Korea Trade Commission. He is familiar with the procedures of the Korea Customs Service and has been counselling multinational companies in border enforcements against imitations and counterfeits.
In addition, Mr Park is a key member of Lee & Ko’s gaming practice group and has a wealth of knowledge and experience in the gaming industry as a whole. He has represented major Chinese game companies in acquiring shares from a major Korean internet company; advised on use-of-service and consumer-information agreements for Nextfloor’s game software; advised a US gaming company on regulatory issues related to game tournaments; assisted in Shanda’s acquisition of an internet gaming company; and advised on game publishing and development agreements for Neowiz and other major gaming companies. Mr Park has also advised gaming clients in numerous IP disputes, including patent infringement cases.
He is a member of the Korean Bar Association and the Korean Patent Attorneys Association. He received an LLB from the College of Law at Seoul National University in 1992; and an LLM from Georgetown University in 2007.
