Who's Who Legal Mexico - Government Contracts

Mr Sergio Olivar is currently the lead partner at Noriega y Escobedo, AC, specialised in corporate law, projects and infrastructure, government contracts and public-private partnerships.

For over 20 years now, Mr Olivar has advised the public sector in all the different phases of infrastructure projects, such as planning and project selection; analysis and establishment of the regulatory framework and the optimum legal schemes for its implementation, including the obtention of all the authorisations required for its approval; design and formulation of all the legal documents needed for the conduction of the different bidding and procurement processes, under diverse legal modalities such as concessions, traditional civil works, PPS (services providing projects) and APP's (public-private partnership), including the design and formulation of bidding bases, concession titles and/or any agreements and contracts needed for this purpose; likewise, he has formulated highly complex projects in which the three governmental levels and the private sector have been involved; structural development and assistance in the different bidding procedures, including the evaluation of the bidding proposals, pronouncing and granting of the judgment, its posterior legal and financial closure, and lastly, the initiation of the projects; monitor compliance with obligations of both the public and private sector in the construction and operation phases.

On the other hand, Mr Olivar advised the private sector in all the different phases of the procedures for the obtention and execution of infrastructure projects, under diverse legal modalities. In this regard, he has been in charge of the formulation of three unsolicited proposals of great importance and impact including the telecommunications sector under the new legal scheme established in the Public-Private Partnerships Law.

In addition, Mr Olivar has wide experience at international levels regarding infrastructure projects, such as the providence of legal advice and qualification to the governments of El Salvador and Colombia.

Aside from his professional experience, during recent years he has been a guest and adviser of the Inter- American Development Bank for the enhancement and promotion of public-private partnerships in the different states and municipalities of Mexico.

Moreover, he has published various articles regarding project structuration under the APP scheme, and has been an expositor in diverse seminaries and series of conferences regarding the implementation of programmes for the development of infrastructure projects under public-private partnership schemes in Mexico, among which the Inter-American Development Bank and the Mexican government, in both local and federal levels, are included.

Mr Olivar's professional experience in this practice area includes the negotiation, preparation and execution of credit contracts and trusts for the fulfillment of diverse projects.

Sergio Olivar has been involved in many relevant complex construction projects, acting in different capacities. Such projects include the international project bidding road Necaxa - Tihuatlán in the states of Puebla and Veracruz, the international competitive bidding for the highway project Tepic-Villa Union, in the states of Nayarit and Sinaloa, the international project bidding road Zacatecas- Saltillo, the international project bidding road Nueva Italia-Apatzingan in Michoacan, the international competitive bidding of Ciudad Valles-Tamuín, among others.

In the water sector, Mr Olivar worked as legal counsel of the Sistema de Aguas de la Ciudad de México (Water System of Mexico City) (SACMEX) and legal counsel of the Aqueduct El Zapotillo project, in collaboration with the National Water Commission (CONAGUA).

He was involved in legal services to the Electricity Federal Commission (CFE) as well as legal adviser for the design and implementation of public lighting projects under schemes of public private partnerships in various municipalities of Mexico.

Mr Olivar has a vast experience as adviser for the bank institutions, including the National Infrastructure Fund and Banco Nacional de Obras y Servicios Públicos (BANOBRAS) in the negotiation of various financing schemes in different sectors, such as energy, telecommunications, water treatment plants, landfills, urban solid waste disposal, wind farms, tourist resort developments and sustainable housing projects.

Additionally, he was a distinguished university professor at the Panamerican University for more than seven years where he taught corporate law, and particularly trade contracts and is an active member of the National Association of Corporate Lawyers (ANADE),  member of the Mexican Bar Association (BMA), and leads the workshop on arbitration policy at the International Chamber of Commerce.
