Dr Börries Ahrens is a partner in Allen & Overy LLP’s Hamburg office and advises on all aspects of European and German antitrust law. His experience spans a wide spectrum of industries.

A focus of Börries’s practice is investigations and antitrust litigation. Börries frequently defends clients in cartel investigations and represents them in court proceedings regarding follow-on damages actions. He has also successfully appealed against decisions by competition authorities, including the annulment of a lead decision by the German Federal Cartel Office (FCO) on abuse of buyer power. He has represented clients in a range of sector inquiries by the FCO and in ensuing investigations, inter alia, a large German asphalt producer in the asphalt sector inquiry and in subsequent prohibition proceedings.

Börries regularly represents clients in merger control proceedings before the FCO and the European Commission, and coordinates merger filings in other jurisdictions around the globe. Among the high-profile merger control cases he has been involved in is the takeover of Kaiser’s Tengelmann by EDEKA, including proceedings before the Federal Supreme Court concerning the effectiveness of a ministerial permit.

Börries is highly recommended by JUVE (2018). Chambers Europe (2018) notes that Börries is well-regarded in the market for his work on cartels and merger control, quoting an interviewee who states, “He has an excellent reputation in this market, I find him very impressive.”
