Claudio Donato Monge leads the firm’s practice public law, competition law and compliance practices.
In project finance for PPP projects, Mr Donato has served as the main legal counsel in relation to public procurement, public bidding procedures, negotiation and drafting of agreements, and client representation in all different phases required to develop and finance a project. This experience has been in both the private and public sectors, and spans sectors including telecoms, energy, private-service operation of public services, transshipment ports and projects, among others.
Currently, Mr Donato is the only lawyer-member of Grupo Consenso, a pressure group that seeks to influence matters of infrastructure and provide feedback to government authorities and private chambers. He also participated in the drafting of the Regulations to the Private Initiative in Concession of Public Infrastructure and Services Act and the Public Private Partnerships Act.
Mr Donato is a former president of the Competition Commission (Coprocom). Assisted by his team, he has led counsel in various procedures conducted before Coprocom and the Telecommunications Superintendence. Among other achievements, he represented the plaintiff in a process which led to the highest fines ever imposed on this field in Costa Rica. As a defendant, he has represented clients in multiple competition procedures, obtaining the satisfactory drop of all charges.
Since the merger authorisation process was implemented in Costa Rica, Mr Donato has led one of the most country’s most active legal teams. It has successfully obtained authorisations for significant mergers in the fields of pharmaceuticals, tourism, real estate, construction, energy, manufacturing, among others.
