Who's Who Legal Insurance & Reinsurance: Expert Witnesses

Ben D Nolan, III, PE, PSP, is a management consultant to clients involved in insurance disputes related to major capital projects worldwide. In a matter in the London Court of Arbitration, he provided expert analysis of hundreds of insureds’ claims over 10 years of policy coverage for structural defect claim coverage. This expert analysis involved detailed analysis of each structural defect claim to determine if it was a structural defect or not, if the defect originated during the policy coverage period or not, any betterments in the actual repair costs and an opinion of the value of the insurable loss.

Mr Nolan provided expert physical damage and reconstruction cost analysis in dozens of hurricane and flood insurance coverage disputes in the aftermath of Hurricanes Andrew, Ivan, Wilma and Katrina. He conducts cause and origin engineering investigations for major property losses. He investigates structural collapses caused by unusual weather, such as heavy snowfalls and stormwater flooding. He analyses professional liability claims related to engineering design errors and omissions, construction management standard of care claims and construction defect claims.

Mr Nolan advises boards and executive management involved with “bet the company” engineering and contracting project litigation, enterprise-wide and project risk management, project audit and internal audit, risk assessments, internal investigations, dispute resolution, valuation, business strategies, organizational performance and transformation, and similar critical business process assessments and improvement matters.

Mr Nolan has testified as an expert over 50 times on behalf of owners, contractors, insurers and others in federal district courts, state courts, and arbitration and mediation venues nationwide. He has also provided expert advice to federal agencies.
