Who's Who Legal Thought Leaders - Arbitration

Frank Ilett has been an accountant for 35 years, focusing on forensic accounting for the past 26 years. He first gave expert evidence in 1999 and has worked on over 150 matters, ranging from under

US$1 million to over US$2 billion in dispute. He is a founding, and the managing, partner of Haberman Ilett, having previously spent 27 years at Big Four accounting firms. He is described as an excellent communicator with unlimited drive, focus and determination to succeed.

Describe your career to date.

Challenging – which is perhaps unsurprising because I love a challenge. I started work at 19 in the incomplete records department of a small accounting firm. I progressed to auditing, preparing management accounts and tax returns, then moved into a Big Four firm. After a short spell in audit and working overseas, I moved into forensic work. I love the intellectual rigour of the work and the fact that the tiniest details, when analysed properly, can change a very large case.

How do you distinguish yourself from competitors in the market?

All clients want experts who offer an excellent quality of service, thorough analysis of the evidence, deep expertise, and the ability to both identify key points quickly, and to explain complex accounting and financial issues in a simple way. I strive to provide these attributes to the best of my ability and in a user-friendly and personable way.

What advice would you share with other experts who hope to one day be in your position?

You have to believe, and know why, you are or can become the best; and follow a plan to get there. That has to be allied with hard work but it has to be the right work. It is the same in sport: you can practise as much as you like on the driving range but if you practise the wrong things you will never become great at golf. Work out what are the right things and work hard at them.

How does Haberman Ilett seek to stay ahead of the competition when attracting new clients and maintaining existing relationships?

We offer outstanding quality, depth and breadth of experience and independence in our work. Our financial and reward structure supports teamwork rather than creating division. We keep doing things that work well, we stop doing things that do not and we try to have some fun along the way. The natural outcome of this is that we expect to perform better than our competitors.

How would you like to see the firm develop in the next few years?

I would like to see the continued growth and development of our younger partners to become recognised as leading experts in their own right. Their success will enable us to attract more high-quality staff and continue to provide lawyers and clients with the accounting support they require.

What qualities do clients look for in an expert witness?

Genuine expertise is a pre-requisite as well as a track record of preparing expert reports and giving expert evidence. Key personal qualities include: excellent communication, understanding the legal team’s needs in the case, confidence in one’s own abilities and opinions, being able to balance leadership and teamwork, staying calm under pressure.

From your perspective as an expert witness, what would you say is the greatest challenge facing individuals active in arbitration in the UK?

Technological developments. Individuals, companies and governments retain vast amounts of electronic data. New technology will help us retrieve and analyse that data; experts will need to understand these developments in order to achieve competitive advantage.

Frank Ilett is managing partner at Haberman Ilett LLP. He has specialised in forensic accounting since 1991, spending 22 years in Big Four firms (13 as partner) before joining Philip Haberman at Haberman Ilett LLP.

Frank has been actively involved in over 150 matters including commercial disputes, shareholder disputes, investment treaty claims, transaction-related disputes, negligence claims and disputes arising out of accounting and financial irregularities. His experience spans most industry sectors.

He has given oral evidence numerous times in the English courts and before international arbitration tribunals, including the LICA and the SAAA.

Frank is one of a small number of expert accountants to have been appointed as an expert assessor under the Arbitration Act 1996.

He is described by colleagues and clients as very easy to work with and an excellent communicator. He is very focused on producing high-quality work while also keeping his clients fully informed of progress.

Frank qualified as a chartered accountant in 1986 and has been a fellow of the Institute of Chartered Accountants in England and Wales since 1997. He is an approved determining expert on the ICAEW president’s appointments list and a CEDR-accredited mediator.

Frank Ilett is managing partner at Haberman Ilett LLP. He has specialised in forensic accounting since 1991 and led the UK dispute services practice of a big four firm before launching Haberman Ilett in 2013.

He has worked on many such cases since his first involvement in the Pegler v Wang case in which he provided expert accountancy evidence in 1999. He is also very experienced as a quantum expert in all aspects of sale and purchase agreement disputes.

He is described by colleagues and clients as very easy to work with and an excellent communicator. He is very focused on producing high-quality work whilst also keeping his clients fully informed of progress providing advice that is “clearly presented and absolutely compelling” and another felt that “the advice we were getting was impeccably prepared, totally sound, well presented and pragmatic”.

Frank has been a fellow of the Institute of Chartered Accountants in England and Wales since 1997.  He is an approved determining expert on the ICAEW President’s appointments list and a CEDR-accredited mediator. He is a regular speaker on quantum issues in IT disputes and regularly provides training for lawyers and accountants on completion accounts disputes and warranty claims.
