Mr Dustin Baxter received his BA degree from the University of Oregon, graduating summa cum laude, in 2002. He then earned his JD degree from the University of Oregon School of Law in 2005. Mr Baxter is admitted to practise law in both Georgia and Oregon. Mr Baxter lived in Oaxaca, Mexico, for two years during his undergraduate studies and as a result speaks, reads and writes fluent Spanish.

Mr Dustin Baxter’s emphasis is on US immigration and nationality law; federal court litigation on immigration matters; and consular visa matters.

Mr Baxter is a partner with Kuck Immigration Partners LLC, practising in all areas of US Immigration and Nationality Law. Mr Baxter prepares immigrant (EB1, EB2, EB3 NIW) and non-immigrant (B, E, F, H, J, K, L, O, T, U) visa applications, PERM applications, and I-140 applications. Mr Baxter also represents employers in I-9 and other worksite enforcement-related matters. Mr Baxter regularly represents clients before US Citizenship and Immigration Services seeking both employment and family-based adjustment of status and naturalisation.

Mr Baxter regularly represents clients before the Executive Officer for Immigration Review, including immigration courts nationwide and the Board of Immigration Appeals. Mr Baxter represents foreign nationals seeking asylum, cancellation of removal, NACARA, TPS, and adjustment of status before Immigration Judges. He also prepares appeals to the Board of Immigration Appeals and Federal Circuit Courts, and has prepared writs of mandamus to the Federal District Court seeking adjudication of long-pending delayed applications.

Prior to joining Kuck Immigration Partners, Mr Baxter was an attorney adviser with the US Department of Justice through the prestigious Attorney General's honours programme.

Mr Baxter is a member in good standing of the State Bar of Georgia, the Oregon State Bar, and the American Immigration Lawyers Association (AILA).

Mr Baxter has served on the AILA national executive office for immigration review committee for each of the past two years, working to resolve issues confronting foreign nationals and attorneys who are appearing before the nation’s Immigration Courts and the Board of Immigration Appeals. Mr Baxter is also the chair of the AILA Atlanta chapter’s US citizenship and immigration services committee. In addition, Mr Baxter has served as a national mentor to attorneys representing individuals seeking humanitarian parole, an extraordinary form of relief designed to allow otherwise inadmissible foreign national to enter the United States due to exigent circumstances.

Mr Baxter is regularly invited to speak to different groups and organisations on immigration-related topics such as: asylum law; immigrant rights; humanitarian parole; immigration consequences of criminal convictions; worksite enforcement of immigration laws; family-based immigration law; and non-immigrant visas.

Mr Baxter’s publications include Overview of Humanitarian Immigration Parole and the 2008 GAO Report (LexisNexis Expert Commentaries, 9 April 2008); and Kuck and Baxter on the Social Security Administration's "No-Match" Letters (LexisNexis Expert Commentaries, 15 January 2008).
