John Yong Ren is the founder and managing partner of T&D Associates based in Beijing, China. John founded the first and biggest antitrust group in China in 2003, which has been assisting clients on all aspects of AML with expertise in a broad range of antitrust issues, including merger control, cartels, abuses, etc. Since 2008, John’s team has successfully represented multinationals in more than 300 merger notifications and dozens of high-profile antitrust investigations in China.

WHAT INSPIRED YOU TO SPECIALISE YOUR PRACTICE IN COMPETITION LAW?

In  2003, the Ministry of Commerce of PRC (MOFCOM) started to push the legislation of AML. Multinationals such as Microsoft, Intel and Qualcomm were in great need of help from local firms in antitrust matters, but none of the local firms in China practised antitrust law. To respond to such need, I started to specialise in this area.

AS FOUNDING PARTNER, WHAT WAS THE MOST CHALLENGING ASPECT OF SETTING UP YOUR OWN ANTITRUST GROUP?

I started from zero to build and train my own team, while Chinese antitrust law was in its infancy.

HOW DO YOU ENSURE THAT YOUR TEAM REMAINS A LEADING PLAYER IN THE CHINESE MARKET?

It’s important to keep a close eye on the development of China’s antitrust law and maintain good working relations with authorities; to be creative and provide value-added service; to give my team constant training updates; to research and write antitrust-related articles; and to attend symposiums and seminars.

AS MANAGING PARTNER, WHAT ARE YOUR MAIN PRIORITIES IN TERMS OF THE FIRM’S DEVELOPMENT AT THE MOMENT?

To maintain good relationships with clients, and to provide a high-quality legal service.

HOW HAS CHINESE COMPETITION LAW EVOLVED SINCE YOU FIRST BEGAN PRACTISING IN THE SPACE?

The legislation of AML, initiated in 1994, was accelerated in 2003, the year I started practising antitrust law, and finally took effect in 2008. Compared to the EU and the US, China’s antitrust legislation/enforcement started relatively late. The legislators, enforcement authorities and attorneys are still learning. The current problem is that the efficiency of the three Chinese enforcement authorities must be improved; and we suggest that they be merged into one authority.

TO WHAT EXTENT IS A GOOD RELATIONSHIP WITH THE COMPETITION AUTHORITIES NECESSARY FOR A SUCCESSFUL PRACTICE IN CHINA?

It is important to be respectful and strictly obey the antitrust laws and regulations; and to be professional, in order to win the competition authorities’ trust and gain recognition.

LOOKING BACK OVER YOUR CAREER, WHAT ARE YOU MOST PROUD OF THUS FAR?

I founded the first and biggest antitrust group in China. I’ve represented multinationals in a variety of industries from Europe, the US and Japan, and have had great achievements before the competition authorities.

John Yong Ren is the founder and managing partner of T&D Associates based in Beijing, China.

John started his career as a certified lawyer in 1988. In 2003, he founded the first and biggest antitrust group in China. Led by him, the team has been assisting clients on all aspects of the AML with expertise in a broad range of antitrust issues, including merger control, cartels, abuses, etc. With experiences of participation in the legislation of the AML and related administrative rules as well as a good working relationship with three AML enforcement authorities, he successfully represented multinationals in more than 300 merger notifications (including the recent Dow/DuPont, Qualcomm/NXP and AT&T/Time Warner with MOFCOM, etc) and dozens of antitrust investigations (including the recent Tetra Pak case with SAIC and most cartel and abusive cases involving multinationals with NDRC) in China since 2008.

T&D Associates has been recognised by Chambers as the PRC competition/antitrust law firm of the year eight times (2010–2017).

John is also keen to promote the development of the AML. Since 2005, John has co-hosted a total 27 AML symposia with the Competition Law Centre of UIBE, with participants including senior officials from MOFCOM, NDRC, SAIC, DOJ, FTC, EU DG Comp, JFTC; top antitrust scholars and experts; in-house counsels of multinationals, etc. Additionally, he translated Antitrust Law and Economics, written by Professor William Kovacic, into Chinese.

John also serves as an arbitrator in the China International Economic and Trade Arbitration Commission, and as a panel member in the antitrust committee of the Beijing Lawyers Association.
