Who's Who Legal Competition: Lawyers

Valentin Berea is a partner at RTPR Allen & Overy LLP and specialises in competition, dispute resolution and intellectual property law.

He advises multinational companies on contentious and non-contentious competition law matters and coordinates their defence in contentious cases. He has successfully advised: Allianz Tiriac Pensii Private SA in relation to obtaining a 50 per cent reduction on a fine imposed by the Romanian Competition Council through a final ruling of the High Court of Cassation and Justice; British American Tobacco on a high-profile investigation by the Competition Council (including dawn raid proceedings) that was finalised without sanctions being applied to the client; Ursus Breweries (SABMiller) on a sector investigation into the beer market by the Competition Council, as well as on day-to-day competition law matters; Tymbark Maspex on an investigation by the Romanian Competition Council in a high-profile vertical agreements case (also involving Metro, Billa and Selgros); GDF Suez Energy Romania on a complex competition law compliance programme; Zenith Media (a subsidiary of the global media network Publicis Group) on an antitrust investigation in the Romanian market; a McCormick Romanian subsidiary on an investigation by the Romanian Competition Council into a potential illegal vertical agreement (also involving Metro, Billa and Selgros); a Vodafone and Orange joint venture on a networking-sharing project; and UTI Systems and Netcity Telecom on a sector investigation into the competition aspects of the NetCity Project (an underground telecoms infrastructure project in Bucharest). This also involved a high-profile litigation case against the Romanian telecoms authority, ANCOM.

In antitrust litigation, Valentin has won some notable cases. Together with his team, he succeeded in obtaining the first significant reduction (over 80 per cent) of a fine imposed by the Competition Council (on the insulin-trading market), based on a mitigating circumstance. This has set a precedent in court of reducing the fines imposed by the competition authority.

He is a certified intellectual property counsellor for trademarks and industrial designs and is a long-standing assisting professor teaching contract law at Bucharest Law University. Valentin is a member of the Romanian Bar Association.

He graduated from the Law School of Bucharest University and from the University of Paris I, Panthéon-Sorbonne. A client quoted in Chambers Europe (2016) describes Valentin as having “proven to be exceptional in every way possible, with his insight, strategic thinking and approach to different cases. I think very highly of him.” Chambers Europe (2014) refers to Valentin as a “very capable and experienced lawyer” in the field of competition/antitrust. Chambers Europe (2011) stated that he is “very impressive” and “a strong mind in competition law”.
