Dr Assimakis Komninos is a partner at the Brussels office of White & Case LLP. He advises on questions of EU and Greek competition law, EU business regulation, international arbitration, litigation and private international law. He is unique in having argued both of the only two competition preliminary reference cases to the European Court of Justice from Greece.
His practice focuses on complex cases of abuse of dominance, restrictive agreements and merger notifications, and he represents clients before the European Commission, national competition authorities, national courts and international arbitration tribunals. Clients look to Assimakis for his proven track record and his ability to quietly resolve the most sensitive and complex investigations, and also to aggressively litigate to achieve the necessary results.
Between 2009 and 2011 he was a commissioner and board member of the Hellenic Competition Commission (HCC). As a commissioner, he headed the Greek delegation at OECD and ICN meetings. In 2010 he was appointed, by the Minister of Development, as a member of the group of experts that worked on the preparation of the 2011 Greek Competition Act.
Assimakis has acted before the European Court of Justice in Syfait v GlaxoSmithKline and Lélos v GlaxoSmithKline (parallel trade of pharmaceuticals – abuse of dominance), and in GlaxoSmithKline Services v Commission (parallel trade of pharmaceuticals – article 101). He was also involved before the EU General Court in Microsoft v Commission (compulsory licensing of interoperability information), GlaxoSmithKline Services v Commission (parallel trade of pharmaceuticals – application of Article 101), Chalkor Metal Works v Commission (copper plumbing tubes) and Public Power Corporation v Commission (Greek lignites). Assimakis successfully represented Aegean Airlines in Aegean/Olympic II, which resulted in the European Commission for the first time clearing a deal it had previously blocked. He has also acted in other complex Phase II cases in the energy, communications and other sectors.
Assimakis has represented or advised clients with excellent results in proceedings before the Albanian, Cypriot, French, Greek, Kosovo and Romanian competition authorities and Belgian, Bulgarian, Cypriot, French, Greek, Latvian and Spanish appellate courts, and has particular expertise in arbitration cases involving EU and national competition issues, and in private antitrust litigation cases in national courts.
He is recognised in the “Spotlight Table” in Chambers Global for EU competition law and corporate/commercial (Greece); Who’s Who Legal: Competition (2014, 2015 and 2016); and Who’s Who Legal: Life Sciences (2015 and 2016). Assimakis is the winner of the Client Choice Award 2015 for the competition category for European Union.
He is currently a visiting fellow of the Centre for Law and Governance in Europe at University College London (UCL), where he teaches competition law subjects, and a senior associate fellow of the Institute for European Studies (IES) at the Vrije Universiteit Brussel (VUB). He holds a summa cum laude law degree from the University of Athens, an LLM from the University of Cambridge (Trinity College), an LLM from New York University, and a PhD from the European University Institute. He is a member of the Brussels (E-list) and Athens Bars (Supreme Court). Assimakis is also a non-governmental advisor to the International Competition Network (ICN).
