Jean-Luc Guitera heads the KPMG Forensic team in Paris, responsible for forensic engagements in France and French-speaking countries in Africa.
Mr Guitera has 28 years of experience with KPMG, having been an auditor before specialising first in transaction services (mergers and acquisitions), and then, since 2003, in forensic (fraud and compliance investigations, M&A and commercial disputes, and international arbitration). He has led engagements in France and in more than 20 countries across all continents.
In a transaction advisory role, Mr Guitera has been involved in more than 30 engagements and has worked on major transactions such as the creation of EADS (the leading aerospace and defence manufacturer in Europe) and Airbus. He has also acted as a principal in the disposal of two companies.
Mr Guitera has been involved in more than 60 valuations of all types acting as auditor, transaction services partner leading a due diligence team, court or tribunal appointed-expert (arbitral tribunals, Monaco appellate court), expert witness (arbitral tribunals and French state courts), member of an arbitral tribunal, and independent expert appointed by both parties to determine the final transaction price in mergers and acquisitions operations.
As a financial expert, Mr Guitera has given oral evidence 20 times, in French and English, acting as expert for the claimant or defendant, or as tribunal-appointed expert, in Paris, New York, London, Geneva, Cayman Islands and Bucharest, under ICC, CIRDI, UNCITRAL, OHADA, and ad hoc arbitration rules. His industry experience is quite varied and he has acted as expert on commercial/contractual, construction and expropriation claims. He has been selected to teach the valuation courses at the Paris Arbitration Academy in 2015.
Mr Guitera has also extensive experience of compliance and fraud-related investigations (misappropriation of assets, fraudulent financial reporting, corruption) and has led more than one hundred investigations in the operations of foreign subsidiaries of French-based groups. He has also been involved in a significant number of e-discoveries (US-related or not).
Mr Guitera graduated in economy and finance (Felicitations du Jury, 1988) from Sciences-Po Paris, one of the leading French business schools, and holds a master’s degree in business law and a diploma in tax law from University Paris-II Assas. He is a member of the French Institute of Chartered Accountants, the French Institute of Registered Auditors and of the French Society of Valuers. Mr Guitera is fluent in French and English, and also reads Spanish and Portuguese.
