DESCRIBE YOUR CAREER TO DATE.

Since I have started working at Walder Wyss, I have been specialising in the area of IT, data protection and outsourcing. If, at the beginning, my work was more focused on traditional licensing and outsourcing deals, the past years have increasingly included advice on cloud services, XaaS and data protection. As a partner at Walder Wyss, I regularly handle complex IT transactions and data protection compliance projects in an international environment.

WHAT MAKES IT AND DATA PROTECTION SUCH FASCINATING PRACTICE AREAS TO PRACTICE IN?

Services that were unthinkable in the past have become current practice and new services emerge at high speed. Furthermore, due to changes in data protection laws and in sectors which are heavily dependent on IT and the use of data (healthcare, financial services, etc), new challenges arise. Helping clients to successfully meet those challenges and to stay at the forefront of technology is extremely rewarding.

HOW DO YOU SEE YOUR PRACTICE AT WALDER WYSS DEVELOPING OVER THE NEXT YEAR?

I expect data protection implementation projects to become an increasingly bigger portion of my practice. As regards IT work in general, I continue to see a strong focus on cloud services and XaaS transactions.

WHAT EFFECTS WILL THE PROPOSED REVISIONS TO THE DATA PROTECTION ACT (DPA) HAVE ON THE SWISS DATA PRIVACY AND PROTECTION ENVIRONMENT?

The revision will reinforce the protection of personal data and will require companies to assess and adapt their current practices in due time. Non-compliance will have an increased reputational, operational and financial impact, and awareness will be strengthened.

THE MAXIMUM FINANCIAL PENALTIES FOR BREACH OF DATA PROTECTION PROPOSED IN THE DRAFT-DPA ARE SIGNIFICANTLY LOWER THAN THOSE PROVIDED FOR IN THE EU’S GDPR. WHAT IS THE RATIONALE BEHIND THIS DECISION AND WHAT IMPACT DO YOU THINK IT WILL HAVE ON COMPLIANCE WITH DATA PROTECTION LAW?

Criminal fines of up to 250,000 Swiss francs may be levied under the draft. Because these fines apply primarily to individuals (in particular to officers of companies) and not to the companies as such, the Swiss government does not deem higher fines to be appropriate. We nevertheless believe that the fines foreseen under the draft will lead to increased compliance efforts.

TO WHAT EXTENT IS THE LEGISLATION CURRENTLY GOVERNING CYBERSECURITY AND CYBERCRIME IN SWITZERLAND FIT FOR PURPOSE?

Even though legislation in this area is a patchwork, it is in general fit for purpose. However, because of increasing threats, a more global approach would certainly be desirable.

WHAT DOES THE FUTURE HOLD FOR THE REGULATION OF TRANS-BORDER DATA FLOWS?

Even though Switzerland is not part of the EU/EEA, this will in practice largely depend on the outcome of the challenge to the standard contractual clauses
in the EU and on the review of the EU-US Privacy Shield by the European Commission. In any case, companies transferring personal data from Switzerland abroad should whenever possible ensure that such transfers are not only based on standard contractual clauses but also on other grounds (Swiss-US Privacy Shield, consent).

WHAT ADVICE WOULD YOU GIVE TO LAWYERS WISHING TO MAKE A NAME FOR THEMSELVES IN IT WORK?

In addition to excellent legal skills, it is necessary to follow technical evolutions and to understand the practical needs of clients. It is important to closely follow international developments, to be actively involved in professional organisations and to always stay one step ahead.
