Biography:

Who's Who Legal Competition: Lawyers

David L Meyer is former co-chair of the global antitrust law practice group. His practice spans all facets of antitrust law, including mergers and acquisitions, government investigations, litigation and strategic counselling.

Recent transactions for which he obtained antitrust clearance include: the formation by Qualcomm and TDK of a worldwide joint venture whereby Qualcomm’s acquired control of TDK’s RF filter business; the formation of Talen Energy Corp, SoftBank’s US$21.6 billion acquisition of a controlling interest in Sprint and Clearwire; Sourcefire’s US$2.7 billion sale to Cisco; and Terumo Corporation’s US$2.6 billion acquisition of CaridianBCT. He acted for Norfolk Southern Railway in connection with Canadian Pacific Railway’s unsuccessful unsolicited acquisition offer.

Mr Meyer’s extensive experience defending clients in civil litigation and government investigations includes: representing Amadeus IT Group in pending class action litigation and DOJ’s investigation of the airline GDS industry; defending Seiko Epson against price-fixing allegations in TFT-LCD Antitrust Litigation; handling DOJ and FTC investigations of various clients on coordination and monopolisation theories; and defending pharmaceutical manufacturers in such cases as Clayworth v Pfizer and In re Brand Name Prescription Drug Antitrust Litigation. As lead trial lawyer, Mr Meyer won an order declaring invalid a state energy regulatory programme in PPL EnergyPlus v Nazarian, which was affirmed by the US Supreme Court in Hughes v Talen Energy Corp.

Mr Meyer also routinely counsels clients on complex compliance issues, potential acquisitions, ventures and alliances, pricing and distribution arrangements, and industry standard-setting.

Mr Meyer joined Morrison & Foerster from the antitrust division of the DOJ, where he served as the Principal Deputy AAG and DAAG for Civil Enforcement. While at the division, Mr Meyer supervised such matters as the investigations of Google’s proposed agreement with Yahoo!, the XM-Sirius merger and the CME’s acquisition of the Chicago Board of Trade.
