Who's Who Legal Competition: Lawyers

Samir R Gandhi heads the competition practice at AZB & Partners and deals with a broad range of competition law and policy issues, as well as international trade and WTO matters.

Samir advises on all areas of competition law and policy and has previously served as counsel to the Competition Commission of India (CCI) in major litigation, including in CCI v SAIL, the first substantive competition law case decided by the Indian Supreme Court. He represents clients in behavioural cases before the CCI, appellate and writ courts across a number of sectors such as cement, automobiles, pharmaceuticals, healthcare, internet and aviation. Recent successes include representing Lafarge in a cement cartel case where the Competition Appellate Tribunal (COMPAT), remanded the CCI’s finding of contravention for reconsideration; and Google in a writ petition before the Delhi High Court, which clarified the CCI’s power to review its own initiation decisions.

Samir has worked on numerous merger filings and was part of the advisory team to the CCI that helped shape the 2011 merger regulations. The firm has a significant merger control practice and recent work on global transactions include advising GE in its acquisition of Alstom’s power and grid business; Pfizer in its merger with Allergan; Dell in its acquisition of EMC; SABMiller in its acquisition by InBev; and Nokia in its acquisition of Alcatel-Lucent. Representation on significant domestic transactions include: advising American Tower Company in its acquisition of shares in Viom; and advising the merging parties in the Bharti Retail/Future Retail merger. The firm was also the first to successfully challenge a gun-jumping penalty imposed by the CCI on Thomas Cook before the COMPAT.

Samir routinely advises companies on their competition compliance programmes and on leniency applications. He has advised sovereign governments on the formulation of competition laws and has appeared before the Indian Parliamentary standing committee to comment on the proposed amendments to the Competition Act.

He is an officer of the IBA antitrust committee and serves on the editorial board of Competition Law International. Samir is listed as a leading competition lawyer in India by Chambers & Partners, Legal Media Group’s Guide to the World’s Leading Competition & Antitrust Lawyers, and Practical Law Company's Competition & Leniency multi-jurisdictional guide.

Samir is a graduate of the National Law School of India University, Bangalore, and the London School of Economics and Political Science, where he was a Commonwealth Scholar and Mahindra Trust Fellow. He was a visiting fellow at Columbia Law School and is admitted to practise in India.

The competition practice at AZB & Partners comprises 15 lawyers and two partners and is spread across the National Capital Region, New Delhi (Noida and Gurgaon), Mumbai, Bangalore and Pune. It has been highly recommended by Chambers & Partners and was named as Competition Law Firm of the Year in India (2016) at the Corporate Intl Magazine Global Awards.
