Rémi Passemard is a partner at leading French law firm Bouckaert Ormen Passemard. A practising lawyer for more than 20 years, Rémi was a partner at a major UK firm before participating in the creation of BOPS in 2004. Bouckaert Ormen Passemard is a highly regarded law firm in the areas of commercial litigation, liability, insurance and reinsurance.
Rémi advises insurance companies, financial institutions and other major corporations, focusing on commercial litigation, insurance, banking and financial law.
On the insurance side, Rémi has developed his expertise in financial lines (D&O, EPL, IPO, financial institutions, IPO and crime fraud) including policy wording, liability cases (PI, E&O, general liability, etc) and life insurance and reinsurance issues. Rémi has also been involved in coverage issues arising from international insurance programmes made of French and foreign insurance policies. He gained extensive experience in assisting EU insurers willing to market insurance products tailored to the French market.
Rémi also advises Luxembourg and/or EU-based life insurance companies proposing life insurance policies complying with French law to French high net worth individuals. His representative cases include acting as monitoring or coverage counsel for the leader of the D&O French market in respect of directors’ liability cases brought before French, US and UK courts; acting as counsel for UK carriers in French EPL and D&O cases involving French subsidiaries of UK parent companies; monitoring for the directors of a French financial institution regulatory and liability claims brought in Italy and advising on implementation of local D&O insurance policies and the D&O master programme; coverage litigation concerning a layered D&O insurance programme of a French listed company in connection with US securities claims (claims for coverage of defence costs in the region of €20 million).
On the commercial and banking side, Rémi regularly acts as defence counsel before French courts in banking litigation cases concerning debt recovery, implementation of securities, investments on stock markets, unit-linked life insurance contracts, and disputes arising from investment structuring transactions (wealth management).
Representative cases include various claims relating to financial investments, structured products, private banking and wealth management; claims in connection with fully lost investments in “Madoff-related” products.
Rémi contributed the France chapter of the Insurance Institute of London's Directors and Officers Liability Insurance (2010). He has also participated as speaker at various conferences, on such topics as regulatory changes in France affecting financial institutions (C5 European Forum, Munich, May 2010). He has also spoken at IFE’s annual life insurance seminar in Luxembourg (2012 and 2013).
Rémi holds master’s degrees from the University of Paris I – Sorbonne in international private law and international trade law (1990), and European law (1991). He is a member of the French Association of Risk Managers (AMRAE), the French Association of Insurance and Reinsurance Lawyers (AJAR) and the French Association of Banking Lawyers (ANJB).
