Dr Alexander Birnstiel is a partner in Noerr's Brussels and Munich offices. He heads the firm's antitrust & competition group and is a member of Noerr's compliance and investigations group. He advises and represents national and international clients in German and European antitrust investigations, behavioural matters, merger cases and private enforcement matters including litigation. Furthermore, Alexander has extensive experience in designing and implementing competition compliance programmes and in state aid matters. He also focuses on clients from the automotive, aviation, chemicals, financial services, IT, media, (re)insurance, retailing, pharmaceuticals, sports and steel sector.
Current and recent assignments include advising and representing (i) Daimler re multi-jurisdictional filing and State aid matters; (ii) Bahlsen, Commercial Metals Corporation, HUK-Coburg and Robert Bosch re a variety of private enforcement matters and follow-on litigation; (iii) the H2 Mobility initiative (Air Liquide, Daimler, Linde, OMV, Shell and Total) on the merger control and State aid implications of setting up a hydrogen infrastructure network in Germany; (iv) SKW Stahl-Metallurgie before the European Court of Justice and the German Federal Court of Justice in litigation related to the European calcium carbide cartel; (v) ThyssenKrupp regarding an alleged cartel in the car steel sector and internal investigations; (vi) German public broadcaster ZDF in relation to damages claims concerning cable TV feed-in contributions and (vii) a number of German and international clients re pending German and European antitrust investigations and related complex internal investigations.
Alexander is a member of the American Bar Association (ABA) and its antitrust section, the International Bar Association (IBA) and its antitrust law committee and the German Antitrust Lawyers' Association (Studienvereinigung Kartellrecht). He is co-editor of a comprehensive commentary on European state aid law (Europäisches Beihilfenrecht, Nomos Verlag, 2013) and frequently contributes as a speaker and panel chair on national and international antitrust conferences.
Alexander has been recognised as a leading antitrust lawyer by various publications including Best Lawyers, The Legal 500, the Who's Who Legal, both in its competition and Germany editions, and JUVE Handbook, where he has additionally been ranked among the "leading names" in media antitrust. Furthermore, German business magazine Wirtschaftswoche has selected Alexander among Germany's pre-eminent antitrust lawyers. Alexander studied at the universities of Munich, Bonn, Geneva, and at the College of Europe in Bruges, and speaks German, English and French.
