Andrzej Kmiecik is a partner in Van Bael & Bellis’ Brussels office. His practice focuses on all aspects of competition law, particularly merger control proceedings and cartel cases, as well as distribution, pricing, intellectual property, and state aid matters. He represents clients before the European Commission, the EU Courts and in national competition law proceedings.
Andrzej’s practice covers a range of sectors, including automotive products, pharmaceuticals, paper and board products, office equipment, consumer electronics, aerospace, petrochemicals, clothing and footwear.
He has handled such high-profile EU merger control cases as Boeing/McDonnell Douglas; Enso/Stora; Boeing/Hughes; Caemi/Mitsui/CVRD; Boeing/Lockheed/ULA; SABIC/Huntsman; SABIC/GE Plastics; DFDS/CRO Ports/Älvsborg; and Canon/IRIS (article 22 referral). He has also acted as defence counsel in a range of EU cartel investigations (such as Newsprint, Fine Papers and Car Parts), and has successfully defended clients against complaints of exclusionary conduct before the European Commission (including Canon and Honda).
Andrzej's experience extends to acting as counsel in major EU antitrust investigations involving the life sciences sector, including Becton Dickinson/Novo Nordisk, Lederle/SKB and Chiron/DRK. He was actively involved in the Commission’s pharmaceutical sector inquiry.
He has also developed a niche practice in the field of motor vehicle distribution. He counsels and defends a number of manufacturers, combining extensive experience with in-depth industry knowledge.
Andrzej regularly lectures and writes on competition law matters and is the coordinating contributor to Van Bael & Bellis’ Competition Law of the European Community (Kluwer, 2010). He has been recognised as a leading practitioner by Chambers Global, Chambers Europe, Expert Guides, The Legal 500, IFLR 1000, Best Lawyers and PLC’s Which Lawyer?
Andrzej completed his MA at Merton College, Oxford University. He also studied at the College of Law in London and received his diploma in European law from the College of Europe. He is qualified as a solicitor in England and Wales and is a member of the Brussels Bar.
