Who's Who Legal Environment: Environment

Kristina Nordlander has a thriving EU regulatory, litigation and competition practice, representing major companies, including in chemicals, mining, financial services, technology and life sciences.

Her EU regulatory experience focuses on environment and chemical regulation, including REACH compliance and classification and labelling rules.

Kristina is an experienced litigator before the EU Courts, including in major cases regarding product regulation/classification and access to documents from EU institutions and agencies. She brought one of the first EU Court challenges against REACH candidate listing.

Kristina’s recent experience includes representing: Bayer CropScience in an appeal before the EU General Court concerning restrictions on the use of neonicotinoid substances in plant protection products; Philip Morris in several precedent setting access to documents litigations before the General Court; Bayer CropScience and Bayer Environmental Science on various regulatory issues, including GMO product approvals, the legal assessment in the EU of various new breeding techniques, procedural issues and complaints around the assessment of plant protection and biocide products and their active ingredients, and ECHA procedures; CropLife International AISBL to help them monitor legal developments across the world on regulatory data protection and trade secrets; CropLife America, American Chemistry Council and the NAM as interveners in the Court of Justice of the EU in Commission v Greenpeace, a precedent-setting case about the obligation to disclose regulatory data under the “emission rule” in the EU Aarhus Regulation; and Nickel Institute on the implementation of the UN’s Global Harmonized System of Classification and Labelling and on REACH issues.

She has also represented a major cosmetics manufacturer and its main supplier on REACH evaluation and appeals to the Board of Appeal of ECHA and the General Court; the cosmetics industry on the application of animal testing bans under the Cosmetics Regulation; a multinational chemical company on data sharing obligations and negotiations arising from a new EU regulation on biocidal products;  a leading biotech company on various matters including legal and advocacy strategies towards the acceptance of a low level GMO presence threshold rule in the EU, potential litigation; whether certain new breeding techniques fall within the EU and U.S. GMO legal frameworks; and hazard cut-off criteria in the plant protection products regulation and related trade law issues; a leading biotech company on complex renewal procedures for GMO products; and a leading biotech and pharmaceutical company on the design and roll-out of a multi-jurisdictional survey, with a view to assessing and comparing legal risks associated with the conduct of GMO field trials in eight countries, including in the US, South America and Asia.

Kristina has also helped clients challenge EU regulations and decisions through WTO agreements, including helping to build coalitions of EU trading partners to oppose the classification of several mineral and metal compounds.

In 2008, Kristina founded the Women’s Competition Network (WCN), the international professional forum for senior competition law and policy professionals. The WCN now counts over 2,000 women holding senior antitrust roles as members and attracts leading business and government speakers for high-level events around the globe.

Kristina teaches and speaks widely on these practices. She studied at the universities of Stockholm and Harvard Law School. Her admissions include New York and Sweden.
