His principal areas of practice are securities and futures-related funds and corporate transactions, including related regulatory matters. Mr Schmidtberger regularly advises and represents clients in domestic and international offerings of hedge funds, fund of funds, public and private commodity pools and structured derivative and principal-protected transactions. Mr Schmidtberger has also counselled clients in numerous fund restructurings and work-out situations.
Representative funds/investment products include: hedge fund and manager formation; public and private commodity pools; fund of funds; private placements (including credit opportunity and hybrid funds); offshore funds and stock-exchange listed offshore funds; hedge and private equity fund 'feeder' platforms; seed capital arrangements and negotiation; employees' securities companies; and credit-enhanced offerings (both parent-guarantee and letter of credit structures).
Mr Schmidtberger is a member of the firm's management and executive committees, and also serves on the board of directors for United Way of New York City. He is a member of the American Bar Association's federal regulation of securities committee and subcommittee on hedge funds.
Mr Schmidtberger received his JD (editor-in-chief, Columbia Human Rights Law Review) from Columbia University School of Law in 1985. He received his BA (cum laude, Phi Beta Kappa, Bennett Cerf Prize in English) from Columbia College in 1982. He is admitted in New York.
