He represents market leaders in semiconductors, telecommunications, medical devices and automotive technology. Through litigation or preparing for large-scale technology transfer between international companies, Jochen Pagenberg helps his clients to negotiate important licence agreements.
Important trademark cases concern parallel importation of consumer products, worldwide coexistence agreements between suppliers, and piracy cases. His practice comprises representation before the General Court and the Court of Justice of the European Union as well as numerous infringement actions before the German courts.
Among Jochen Pagenberg's trademark clients are leading producers of health care and cosmetic products and prestigious French manufacturers of luxury goods. He has also represented a publishing house and author of famous comic strips for more than 30 years.
For more than 10 years Dr Pagenberg has directly contributed to creating a unified European patent court system: from 2000 until 2005 as expert of the European working group for the European Patent Litigation Agreement (EPLA), from 2008 to 2011 as member of the expert group of the European Commission and, simultaneously, between 2005 and 2011 as board member, vice president and president of the European Patent Lawyers Association (EPLAW), the board of which he is still advising today. He is chairman of the special commission of the AIPPI for an agreement on the European Patent Court and member of the working group on dispute resolution of the German Ministry of Justice, which primarily discusses questions and develops recommendations concerning European patent litigation.
Since 1973, Dr Pagenberg has been editor and later co-editor of the English-language IP journal International Review of Intellectual Property and Competition Law (IIC) of the Max Planck Institute for Intellectual Property and Competition Law in Munich. He has published a number of books and more than 80 articles on a wide range of IP subjects in German, English and French.
He has lectured over many years at the Universities of Strasbourg (CEIPI) and Alicante, at the Pierce Law Center (Concord USA), and at the Munich Industrial Property Law Center (MIPLC) of the Max Planck Institute. He has also given numerous presentations covering the entire intellectual property spectrum.
