Ellen Braun, LLM (UC Berkeley), is a German Rechtsanwältin and head of Allen & Overy LLP’s German antitrust practice. She specialises in EU and German competition law.
She has an active practice representing clients in competition proceedings before the EU Commission, the German Federal Cartel Office and the courts. Her practice covers the full breadth of antitrust law and is geared towards long-term competition and antitrust strategies. She regularly advises on merger control (including multiple worldwide filings), and the structuring of cooperation, joint venture and distribution agreements; horizontal and vertical compliance risks (including forensic audits); and strategies to prevent or defend abuse complaints. She also designs and reviews compliance management programmes. Ellen specialises in defending clients in EU and German cartel investigations, including leniency applications, and actioning and defending private enforcement cases in court.
Her long-standing client relationships encompass all industry sectors, among others food, consumer products, general industry chemicals, mining, construction, infrastructure and energy, media and entertainment, as well as financial services.
Recent cases include advising Bell AG in a cartel investigation, now pending before the appellate court in Düsseldorf; CTS Eventim AG & Co KGaA in German investigations regarding competitor cooperation and distribution practices; Evonik in general antitrust compliance matters; OC Oerlikon in multi-jurisdictional merger control reviews for its sale of the vacuum business; Rosneft in several EU and German merger control cases; and Nikon in compliance matters; a global company in a defence against several EU-wide follow-on damage claims based on decisions previously adopted by the European Commission and the German competition authority; and an Asean global producer in pan-European follow-on damage claims based on the two EU CRT cartels.
Ellen is recognised by The Legal 500 Germany (2015) and Best Lawyers for Germany 2015, which recommend Ellen Braun for antitrust law. JUVE (2015) describes her as a “leading senior partner for antitrust law”.
She regularly speaks and publishes on EU and German antitrust law issues. Publications include two chapters in Langen/Bunte (on horizontal agreements under EU law and German law, and on energy antitrust law). Ellen holds an LLM from UC Berkeley and a doctorate in antitrust law from the University of Hamburg. She is also admitted to the New York Bar. Ellen speaks fluent English and French.
