Ellen Braun, LLM (UC Berkeley), is a German Rechtsanwältin and head of Allen & Overy LLP’s German antitrust practice. She specialises in EU and German competition law.
She has an active practice representing clients in competition proceedings before the EU Commission, the German Federal Cartel Office and the courts. It covers the full breadth of antitrust law and is geared towards long-term competition and antitrust strategies. She regularly advises on merger control (including multiple worldwide filings), the structuring of cooperation, joint venture and distribution agreements; on horizontal and vertical compliance risks (including forensic audits); and on strategies to prevent or defend abuse complaints. She also designs and reviews compliance management programmes. A special focus is on defending clients in EU and German cartel investigations, including leniency applications, and on actioning and defending private enforcement cases in court.
Her long-standing client relationships encompass all industry sectors, among others food, consumer products, general industry chemicals, mining, construction, infrastructure and energy, media and entertainment, as well as financial services.
Recent cases include advising: Bell AG in two cartel investigations, now pending before the appellate court in Düsseldorf; two German trade associations and a container transport company in the German diesel floater investigation; Cheminova in a price cartel investigation and multiple merger filings; a global entertainment and ticketing company in a German investigation into its distribution practices; a pan-European logistics company on several cooperation agreements with its sole competitor; Rosneft in several EU and German merger control matters; a pharmaceutical company on compliance management; Villeroy & Boch AG in a third-party complaint against a pan-European merger before several national competition agencies and the EU; an international consumer products company on recourse claims against its board members based on prior antitrust infringements; a global consumer products company in a defence against EU-wide follow-on damage claims based on the European Purity cartel case; and several clients, among them most recently Tchibo, in a successful defence against private damage claims before the civil courts.
Ellen is recognised by all the principal legal directories, including The Legal 500: Germany (2014) which states: “‘Strong communicator’ Ellen Braun is ‘service-oriented’ and has excellent expert knowledge’.”
She regularly speaks and publishes on EU and German antitrust law issues. Her publications include the chapters on horizontal agreements under EU law and German law, and on energy antitrust law, all in the Langen/Bunte (12th edition), the leading German language commentary on EU and German antitrust law.
Ellen holds an LLM from UC Berkeley and a doctorate in antitrust law from the University of Hamburg. She is also admitted to the New York Bar. Ellen is German mother tongue and speaks English and French fluently.
