Austria: Trademarks Analysis 2015

It was another active year for trademark lawyers in Austria. At the start of 2014 the procedure for all IP rights was amended, with one of the changes giving competence to the Vienna Commercial Court in the first instance for all civil law trademark litigation. Several landmark decisions were reached including defining “lack of distinctiveness” and in relation to copyright. In this dynamic sector we identify 12 leading lawyers. 

Schoenherr Rechtsanwälte garners three listings in this chapter. Christian Hauer is a “font of knowledge” on trademark law, while Guido Kucsko concentrates his practice on trademarks, design, copyright and unfair competition. Christian Schumacher impresses with his advocacy and “skilful negotiation”.

Schwarz Schönherr Rechtsanwälte features two lawyers. Markus Grötschl enjoys a “prestigious reputation” in the trademark sector offering clients “bespoke solutions tailored to their needs”. Georg Schönherr is also highly recommended and has an “impressive roster of clients”.

Egon Engin-Deniz heads the industrial property department at CMS Reich-Rohrwig Hainz Rechtsanwälte. His expertise lies in contentious and non-contentious trademark law matters and he represents clients in the media, sports, life sciences, IT and consumer goods industries.

Cizek | IP is represented by Alexander Cizek, a “specialist” in trademark and design law. He has a “resolute focus” and is “personable and versatile”, according to clients.

Michael Horak is a partner at Salomonowitz Horak Rechtsanwälte specialising in trademark law. He has a “stellar reputation” and “unparalleled abilities”.

At his own firm Meinhard Ciresa is noted as a “leading authority” on trademark law with a “commercial approach” that clients truly value.

Christian Gassauer-Fleissner concentrates on IP law advising a range of businesses from entrepreneurs to family owned companies on their trademark portfolios.

Zeiner & Zeiner’s Hans Georg Zeiner is a “notable expert” in trademark law with a “far-reaching reputation”.

Martin Reinisch at Brauneis Klauser Prändl is recommended for his “astute legal mind” and “sophisticated practice”.
