Founded 150 years ago, Orrick Herrington & Sutcliffe is the oldest continuously operating law firm in San Francisco. It boasts 25 offices across the US, Asia and Europe and employs over 1,100 lawyers. Considered one of the most “prestigious” law firms, Orrick is especially renowned for its commercial litigation, competition and labour and employment groups. Management labour and employment is an area in which Orrick excels. The firm fields five “leading lawyers” to this chapter, including Gary Siniscalco in San Francisco: a “senior statesman” in the employment legal market. Siniscalco specialises in equal opportunity, affirmative action compliance, wrongful discharge and cross-border employment issues. In Silicon Valley, Lynne Hermle is acclaimed for her expertise in wage-and-hour class actions, particularly related to the technology and retail industries. Her “illustrious” client list includes Apple, Gap, Sears, Gymboree, Banana Republic, Old Navy and Pottery Barn Kids. In New York, Mike Delikat chairs the firm’s global employment law practice and is the former managing director of Orrick’s litigation division. Peers consider him “one of the best litigators in the state, if not the country” when it comes to employment and labour issues. He is joined by Jill Rosenberg, the “lawyer of choice” for employers in need of defence and advice in discrimination, sexual harassment, whistleblowing, wrongful discharge, affirmative action and wage-and-hour matters. In Düsseldorf, Arno Frings heads the German employment law practice and has over 25 years of experience in the field. Clients praise his “business acumen” and “solutions-oriented approach”.

Orrick has a “highly impressive” competition practice, with lawyers from the firm having played key roles in the shaping of modern competition law in the US, Europe and Asia. Significant cases include the landmark US decision Continental TV v GTE Sylvania and the first case to be accepted by the Beijing First Immediate People’s Court under the new Chinese competition law. In this section four lawyers from the firm are listed, three of whom hail from the San Francisco office. Robert Rosenfeld is chair of the firm’s antitrust and competition group and is “especially well known” for representing Microsoft in numerous proceedings over the past decade. The “legendary” Laurence Popofsky is internationally renowned in the competition legal market due to his “extensive experience” and involvement in many “high-profile” cases. The “fantastic” Stephen Bomse is considered a “leading light” in the field and has an “enviable” client list that includes Coca-Cola, Pacific Gas & Electric, Sara Lee Corporation, Levi Strauss, American Home Foods and UBS. In Paris, Philippe Rincazaux is a “specialist” at both EU and French competition law and is renowned for his “superb handling” of complex cartel cases.

Commercial litigation is also a strong area of practice for the firm and a quartet of individuals are recognised for their work in the corresponding chapter. Düsseldorf-based senior partner Siegfried H Elsing is “renowned” for his “exceptional abilities” as both a litigator and an arbitrator and is recognised across both chapters. He is joined in both chapters by Laurent Jaeger in Paris. A “key figure” in the international litigation legal market, Jaeger is co-head of the firm’s international arbitration group and considered a “first rate” dispute resolution lawyer. Colleague Jean-Pierre Martel features in the commercial litigation, corporate governance and M&A chapters for his “superb” skills. He specialises in financial and securities transactions, business transfers and the liability of managers and auditors and is “very active” in litigation in these areas. London-based Simon Willis is “absolutely brilliant” at commercial dispute resolution in the banking and finance sector and represents a significant number of accountants in professional negligence cases.

Orrick is fast becoming a key player in the international market; over the past 20 years it has more than quadrupled in size. During the last decade alone the firm has opened offices in Milan, Rome, Moscow, Beijing and Shanghai and merged with French firm Rambaud Martel. In 2008 it opened in Düsseldorf, Berlin and Frankfurt following a merger with German firm Hölters & Elsing, and in 2011 it added a Munich office. Last year also saw the firm open an office in Brussels to better serve clients in their dealings with the European Commission and other key European institutions. Orrick continues to go from strength to strength and its success looks set to continue.
