What is the Who's Who Legal 100?

In June 2013, the partners of Homburger elected Daniel Daeniker to succeed Heinz Schärer as managing partner of the firm. Schärer, who had been managing partner since 2004, was elected senior partner of the firm.

Homburger is committed to solving significant and complex business law issues for its clients both in Switzerland and abroad, and aims to provide comprehensive advice to Swiss clients doing business in other jurisdictions. In support of this objective, in 2013 the firm created regional focus groups for Brazil, China, India, Japan, Russia and Turkey which include lawyers familiar with dealing with clients in these countries and their specific needs and constraints.

PEOPLE AND PRACTICES

The firm has a “very strong” capital markets and M&A practice and regularly handles some of the most high-profile and challenging transactions, both domestically and at international level.  The “truly outstanding” Daniel Daeniker heads the firm’s corporate and M&A team and is recognised as the most highly nominated lawyer in this year’s capital markets research. In 2013, he also acted as lead counsel for Investcorp in its sale of Skrill Group to CVC Capital Partners. Heinz Schärer is the deputy head of the corporate and M&A team and has “valuable experience” on all matters pertaining to corporate securities and IPOs. Frank Gerhard has a “highly reputable” practice focusing on M&A, private equity and capital market transactions. In 2013 he acted as counsel to Clariant in the carve-out sale of its textile chemicals, paper specialties and emulsions businesses to SK Capital. Dieter Gericke is a “first-rate” practitioner specialising in public and private M&A transactions, and he recently advised Temenos on its new financing structure, which included a loan facility of $350 million and a bond issuance of 100 million Swiss francs. Claude Lambert is a “major player” in the Swiss M&A market and is an authorised issuers’ representative at the SIX Swiss Exchange.

Homburger is also “renowned” for its leading commercial litigation practice, with more than 30 lawyers dedicated to contentious work. Felix Dasser heads the litigation and arbitration team and is described as a “formidable litigator” by clients and peers alike. He represents companies in major international commercial disputes and advises on white-collar crime and regulatory compliance. Balz Gross is the deputy head of the practice and is a “go-to guy” for complex litigation before Swiss courts and authorities. Thomas Müller is a “key figure” in the Swiss litigation and arbitration markets and advises a wide range of clients in relation to civil attachment proceedings, the enforcement of judgments and international legal assistance matters. Gabrielle Nater-Bass is an “exceptional” litigator and arbitrator with a focus on international commercial disputes, and is commended for her “impressive technical understanding”.   

The firm has a “very active” competition practice and regularly represents Swiss and European clients before the domestic courts and authorities. Franz Hoffet leads the competition practice team and is a “leading” lawyer in the Swiss market. He receives praise for his “candid and considered” advice and has “extensive” experience of representing clients in all areas of Swiss and European competition law. The “terrific” Gerald Brei specialises in European, Swiss and German competition law and is “highly knowledgeable” on a wide range of matters including merger control, distribution agreements and compliance programms. Marcel Dietrich is a lawyer “of the highest standing” and focuses on regulatory markets and associated competition issues.

 

PRO BONO

The firm highly values its pro bono work and throughout 2013 the firm acted for Pro Juventute. One of Switzerland’s biggest charities, it was established in 1912 and is dedicated to supporting the rights and needs of Swiss children.

To achieve this aim, it advises leading national and multinational companies doing business in Switzerland, as well as Swiss companies doing business abroad, and concentrates on Switzerland as a location from which all of their clients’ legal problems can be addressed. A key aspect of Homburger’s business model is its decision to concentrate its practice in Zurich, which enables the best possible collaboration between its specialists.
