Carey Olsen - The Who's Who Legal 100 2014

What is the Who's Who Legal 100?

FIRM OF THE YEAR – GUERNSEY

PEOPLE AND PRACTICES

Investment funds and private equity is a key focus of the firm’s corporate practice and it enjoys a leading reputation in the field. Ben Morgan recently led a team advising Doric Nimrod Air Three Limited on its successful initial public offering on the specialist fund market of the London stock exchange and its listing on the Channel Islands securities exchange. The Guernsey-domiciled, closed-ended fund has a market capitalisation of £220 million which will be matched by debt financing to purchase four new Airbus A380 aircraft which will be leased to Emirates on a 12-year term. Graham Hall is head of the corporate and finance group in Guernsey and has more than 20 years’ experience in investment funds and finance, advising several “high-profile” clients. Tom Carey acts for asset managers, banks and fund promoters on the structuring and establishment of closed-ended and open-ended collective investment schemes. Jarrod Farley is located in the Cayman Islands and he specialises in the establishment of both regulated and unregulated investment funds. He also advises funds on transactions, finance and compliance matters.

The firm’s private client team consists of 32 lawyers including seven partners. Head of the trusts and fiduciary department in Guernsey, Russell Clark advises on both contentious and non-contentious trust matters. Alison MacKrill advises on the creation and administration of trusts and corporate structures with a particular emphasis on trustee advisory work, employee share schemes, commercial trusts and private client work. Robert MacRae specialises in contentious trusts and advises trustees and beneficiaries on complex and sensitive applications for directions from the Royal Court, rectification and variation of trusts, freezing orders and asset tracing. Victoria Connolly is a senior associate in Jersey who specialises in fiduciary law.

Head of the litigation and dispute resolution group in Guernsey, John Greenfield is recognised as an asset recovery “specialist”. Examples of his work include successfully arguing a case in the Royal Court of Guernsey which further extended the liability of victims of criminal conduct to be able to claw back assets held in the island. Greenfield acted for Ikea. Karen Le Cras is also a “talented litigator” at the firm who specialises in banking, finance and trusts litigation, asset tracing and freezing orders. She is “renowned” for her work on cross-border matters.

Further “standout” lawyers at the firm include banking consultant Nigel Carey and M&A “expert” Guy Coltman whose work includes acting for Capita Fiduciary Group Limited on its recent purchase of AIB’s Jersey business on a full cash, debt-free basis.

PRO BONO

Carey Olsen’s pro bono commitment equals an average of a case per day – and that is just in the Jersey office. The firm’s proudest pro bono moment of 2013 was its work on a cyber-bullying case which has led to the Jersey authorities recognising it as an emerging abuse within society and committing resources to tackling it.

LOOKING FORWARD

Carey Olsen’s recent expansion into the BVI and Cayman Islands has seen its funds sector grow considerably while it maintained strong positions in the legal markets of Guernsey and Jersey. 2014 looks to be another successful year for the firm as it furthers its ambition to become the offshore law firm of choice by means of organic expansion and consistent market-leading client service.
